(3) Michelle Janysek of the Hills of Hays <br />stated she was opposed to the expansion of Crystal River Parkway and is <br />concerned the Sector Five Plan was developed before the Hills of Hays <br />Subdivision was developed. (4) Dr. Nico Schuler stated he is a resident <br />of Mockingbird Hills and opposes the Leah to Leah connection due to safety <br />reasons. He also stated he opposes an emergency gate placed on Leah <br />Street. Mr. Mihalkanin moved to delete the 2nd bullet item IIExtension of <br />Leah from Wonder World Drive to Broadway" and the 3~bullet item <br />"Extension of Del Sol Dr. to Leah Ave. extension" on page 3-6 of the <br />Sector Five Plan, and Mr. Mayhew seconded the motion, which passed <br />unanimously. Ms. Hughson stated she would like staff to work on language <br />to include an exit route and if an emergency gate to the proposed <br />development of Mr. Moore is necessary. Mr. Montoya made a motion to delete <br />the 5th bullet item "Extension of Crystal River Parkway north from Staples <br />Road across the San Marcos River to connect with River Road" on page 3-6 <br />of the Sector Five Plan, and Ms. Hughson seconded the motion, which passed <br />unanimously. Mr. Mihalkanin asked staff to look at other options for <br />connection to Hwy. 123, but wants the detail planning to be done by the <br />Transportation Master Plan. The Council then voted unanimously for <br />approval of the Ordinance on first reading. Mayor Chiu then explained <br />since the 90-day period for adoption of an Ordinance would expire soon, <br />the Council could either hold another public hearing or hold a Special <br />Meeting for the second reading. The Council agreed by consensus to hold a <br />public hearing at the next Regular Meeting on April 8, 2002. <br />Mayor Chiu introduced for consideration removal from the table and <br />adoption of an Ordinance on third and final reading, which was read as <br />follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> ADDING A NEW ARTICLE 6, HOST RESPONSIBILITIES OF PARTIES IN <br /> RESIDENTIAL AREAS, TO CHAPTER 34, ENVIRONMENT, OF THE SAN MARCOS CITY <br /> CODE, INCLUDING PROCEDURAL PROVISIONS; PROVIDING FOR PENALTIES; AND <br /> PROVIDING AN EFFECTIVE DATE. <br />Mr. Mihalkanin moved to remove the Ordinance from the table and for <br />adoption on third and final reading, and Ms. Hughson seconded the motion, <br />which passed unanimously. Ms. Hughson asked for an explanation of Section <br />34.702(c). Sherri Russell, Assistant City Attorney, explained Section <br />34.702(c) was added for prosecution in court. The prosecutor will have to <br />prove the host did not advise their guest to move their car. Mayor Chiu <br />inquired as to whether the host would receive a ticket or a warning. Ms. <br />Russell stated the Police Officer would go to the party, give a written <br />warning with a time frame to move the vehicle, and if the vehicle was <br />still not attended to, then the Police Officer would give the host a <br />ticket. The Council then voted unanimously for adoption of the Ordinance <br />on the third and final reading. <br />
