<br />3 <br /> <br />Regular Meeting <br /> <br />April 26, 1982 <br /> <br />Page 3 <br /> <br />Mr. Kreczmer moved for approval of the Ordinance on second reading <br />and Mr. Farr seconded the motion, which passed unanimously. <br /> <br />Mayor Craddock introduced for consideration the adoption of an Ordin- <br />ance on third and final reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ADOPTING A CHAPTER TO BE ADDED TO THE <br />CODE OF ORDINANCES OF SAID CITY, SAID CHAPTER TO BE <br />ENTITLED "INTERIM DRAINAGE AND EROSION CONTROL ORDIN- <br />ANCE" AND TO BE NUMBERED APPENDIX "F", SETTING REQUIRE- <br />MENTS FOR DEVELOPMENT IN SAID CITY; ESTABLISHING THE <br />BURDEN OF PROOF; DEFINING TERMS; REQUIRING REPORTS <br />AND PLANS FOR EROSION AND SEDIMENTATION CONTROL IN <br />SAID AREA; REQUIRING CERTIFICATION OF SAID PLANS BY <br />A REGISTERED PROFESSIONAL ENGINEER; PROVIDING FOR <br />RUNOFF ATTENUATION; SETTING STANDARDS FOR OVERLAND <br />FLOW AND NATURAL DRAINAGE; SETTING STANDARDS FOR <br />STORMWATER COLLECTION AND DISPOSAL SYSTEMS IN SAID <br />AREA; SETTING STANDARDS FOR DRITNAGE IMPROVEMENTS IN <br />SAID AREA; SETTING IMPERVIOUS COVER REQUIREMENTS OR <br />PROVIDING FOR USE OF ALTERNATIVE STRATEGIES; PROVID- <br />ING FOR INSPECTION AND ENFORCEMENT; SETTING FACILI- <br />TIES MAINTENANCE CRITERIA; PROVIDING FOR THE GRANTING <br />OF VARIANCES; PROVIDING AN APPEAL PROCESS; PROVIDING <br />PENALTIES; PROVIDING FOR CONFLICT WITH OTHER ORDINANCES; <br />PROVIDING FOR SEPARABILITY AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mr. Farr moved for the adoption of the Ordinance and Mr. Kreczmer se- <br />conded the motion. Mr. Farr then moved the Ordinance be amended on <br />Page 12, Section 13, Item C, to read as follows: "The City Council <br />shall hear said appeal within fifteen (15) days after the appeal has <br />been filed and must act to revoke said permit within that period," <br />and Mr. Brown seconded the motion, which passed unanimously. <br /> <br />Mayor Craddock then moved the Ordinance be amended to add soil classi- <br />fication on Page 4, Section 4, A(l) to read "Does not have slopes <br />of over 15% and does not have erodible soils, as identified in Appen- <br />dix III, on more than 15% of the tract, or . . .", and Mr. Brown se- <br />conded the motion, which passed unanimously. <br /> <br />Mr. Farr then moved the Ordinance be amended on Page 8, Section 4, F, <br />to read as follows: "No person shall develop land, tracts, parcels <br />or lots requiring compliance with this ordinance for the City of San <br />Marcos, Texas, having a slope of 15% gradient or greater, or having <br />highly erodible soils, as identified in Appendix III, so as to create <br />impervious cover in excess of 35% on slopes from 15% gradient to 25% <br />gradient, or in excess of 20% on slopes over 25% gradient, except in <br />accordance with Section 5. The maximum impervious cover percentage <br />requirement shall only apply to those areas on a parcel of land that <br />are not covered with impervious cover as of the effective date of <br />this ordinance. The impervious cover requirement will pertain to all <br />area within the development which is shown to be on 15% slope or great- <br />er by topographical survey performed by a registered surveyor. Those <br />areas within the development which are not on slopes of 15% or greater <br />will be able to be developed to the maximum allowed under applicable <br />laws," and Mr. Kreczmer seconded the motion, which passed unanimously. <br />The City Secretary then read the amendment identified as Appendix III <br />in its entirety. The Ordinance was then adopted unanimously by the <br />Council. <br />
