b. Obtain, if the structure has been flood proofed in accordance with the <br />requirements of section 39.043, the elevation in relation to the mean sea level <br />to which the structure has been flood proofed; and <br />c. Maintain a record of all such information. <br />(5) When the base flood elevation data is not available from any source, the lowest <br />floor of the new construction and substantial improvements must be elevated to <br />three feet above the highest adjacent grade, (or two feet above the highest crown <br />of the adjacent roadway). <br />(6) Any alteration, repair, reconstruction or improvements to a building that is in <br />compliance with the provisions of this article must meet the requirements of "new <br />construction" as contained in this article; and <br />(7) Any alteration, repair, reconstruction or improvements to a building that is not in <br />compliance with the provisions of this article may be undertaken only if the non- <br />conformity is not furthered, extended, or replaced. <br />Sec. 39.043. Specific standards for AE, AH, and AO Zones. <br />In all Zones AE, AH, and AO where base flood elevation data has been provided, as <br />set forth in section 39.021, the following provisions apply: <br />(1) Compliance with the standards in section 39.041. <br />(2) Residential structures. <br />a. All new construction or substantial improvements of residential structures <br />within zones AE and AH must have the lowest floor (including basement) <br />elevated to two feet foot above the base flood elevation. <br />b. All new construction and substantial improvements of residential structures <br />within AO zone must have the lowest floor (including basement) elevated <br />above the highest adjacent grade at least as high as the depth number specified <br />in feet on the FIRM (at least two feet if no depth number is specified). <br />c. A registered professional engineer, architect or land surveyor shall submit an <br />elevation certification to the floodplain administrator that this standard is <br />satisfied. <br />(3) Nonresidential structures. <br />a. All new construction or substantial improvements of nonresidential <br />structures must have the lowest floor (including basement) elevated to two <br />feet above the base flood elevation.
