(5) The Housing Authority of the City of San Marcos, for construction <br />projects on property owned by it, for low-income housing or <br />administrative offices; and <br />(6) Any taxing unit as defined under Section 1.04(12) of the Texas Tax <br />Code for construction projects having a permitted value of <br />$3,000.00 or less. <br />(c) Residential home improvement exemption. A person making repairs <br />or improvements to a residential dwelling requiring the issuance of a permit by the <br />City is exempt from the payment of all applicable fees imposed under this chapter <br />if. <br />(1) Such person owns and occupies the residential dwelling; <br />(2) The residential dwelling is designated as such person's homestead <br />by the county appraisal district having jurisdiction; and <br />(3) Such person directly performs all work on the repairs or <br />improvements independently or uses other persons to perform the <br />construction work requiring the issuance of a permit by the City. <br />Such persons performing work for the property owner shall, <br />however, be subject to applicable licensing requirements under state <br />law. <br />PRITNOWIFIRGS <br />SECTION 2. Section 14.372(a)(2) of the San Marcos City Code, is hereby amended to <br />read as set forth below. Added text is indicated by underlining. Deleted text is indicated by <br />strikethroughs. <br />Sec. 14.372. License required; exception. <br />(a) It is unlawful for any person to perform construction work subject <br />to this article unless the person is licensed as a contractor or is exempt under one <br />of the following: <br />(1) A maintenance person may perform maintenance work only upon <br />property owned by the person's employer. A maintenance person <br />who performs work upon the property of more than one property <br />owner is deemed to be performing work for the general public and <br />shall be licensed as a city residential or general contractor. <br />(2) A property owner may perform construction work with the owner's <br />own hands or use other persons to perform construction work in/on <br />an existing residence owned and oeettpied by the owner as his <br />
