RESOLUTION 2009-144R <br />• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE SALE OF A TRACT <br />OF PROPERTY LOCATED AT 611 VALLEY STREET BY THE <br />SAN MARCOS CONSOLIDATED INDEPENDENT SCHOOL, <br />TRUSTEE; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The San Marcos Consolidated Independent School District (*'SMCISD"), as trustee for all <br />local taxing units, is the owner of the tract of property at 611 Valley Street (the "Property") through <br />a sheriffs sale of the Property for unpaid taxes. <br />2. SMCISD has received an offer of $1,000 for the Property from Mr. Jonathan S. <br />Winkelman, which is less than the amount of taxes owed on the Property, and less than the appraised <br />value of the Property according to the Hays County Appraisal District. <br />3. The City's tax attorneys have forwarded the bid to the City Council for consideration, and <br />has also forwarded the bid to the other taxing entities for their respective consideration. <br />4. City approval of the bid is necessary for the sale since the bid is for less than the amount <br />of taxes owed on the property. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />• <br />PART 1. The sale of the Property by the San Marcos Consolidated Independent School <br />District, Trustee, for $1,000 is approved. <br />PART 2. The Mayor, Susan Narvaiz, is authorized to execute a deed for this sale on behalf <br />of the City of San Marcos. <br />PART 3.
