C) who have not owned a home within the City of San Marcos during the <br />three year period immediately preceding the date of closing on a home for which down <br />payment assistance is requested under the incentive program described in Section 4.01 of <br />this Agreement ("Qualified Personnel") <br />Qualified Personnel must remain continuously employed in the same or other Qualified <br />Personnel position and maintain their primary residence in the City of San Marcos for a period of <br />at least five years from the date of being hired or contracted. The City of San Marcos shall be <br />responsible for tracking this information. <br />PART 3. IMPLEMENTATION <br />Section 3.01. Within 30 days after the Effective Date, Seton shall designate a <br />representative responsible for coordinating its activities under this Agreement with the City <br />Manager of the City or his or her designee. Within 60 days after the Effective Date, the <br />designated representative of Seton and the City Manager shall jointly develop a written plan or <br />program consistent with the terms below for implementing this Agreement. At least annually, <br />after the adoption of such plan or program, the designated representative of Seton and the City <br />Manager, or his or her designee, shall review the plan or program and make any adjustments or <br />modifications thereto as may be mutually agreed between them. <br />Section 3.02. Seton to Promote Residency Program and Positive Image of San <br />Marcos. At a minimum, under the plan or program established under Section 3.01, Seton will <br />promote the Program and a positive image of the City and the benefits of residing in the City as <br />follows: <br />a) Seton shall provide information, training and/or education through policy <br />directives or other suitable form to all Seton staff involved in direct communication with <br />Page 3 of 8
