City Council Meeting Minutes April 20, 2021 <br />16. Receive a Staff presentation and hold a Public Hearing to receive comments for or <br />against Ordinance 2021-27, amending the Official Zoning Map of the City in Case No. <br />ZC-21-03 by rezoning approximately 21.22 acres of land generally located on Chuck <br />Nash Loop at Riverwalk Drive from "MU" Mixed Use District to "CD -5" Character District <br />5, or subject to the consent of the owner, another less intense Zoning District <br />Classification; including procedural provisions; and providing an effective date; and <br />consider approval of Ordinance 2021-27, on the first of two readings. <br />Shannon Mattingly, Director of Planning and Development Services, provided <br />the presentation on the rezoning of 21.22 acres located on Chuck Nash Loop <br />at Riverwalk Drive. Ms. Mattingly stated the applicant is requesting to change <br />the current Legacy Mixed Use Zoning (MU) to Character District 5 (CD -5). <br />The purpose of this zoning change is to allow a large multifamily development, <br />which is not a permitted use under the current zoning. The site is located next <br />to the Blanco River and the adjacent properties are existing multifamily and <br />commercial uses. Mrs. Mattingly stated that staff recommends alternate <br />approval of this item request to rezone only the northern 13.3 acres of the <br />21.22 acre site to Character District 5 (CD -5). <br />Mayor Hughson opened the Public Hearing at 9:03 p.m. <br />Hugo Elizondo Jr., spoke in support of this project and is the consultant <br />engineer and represents the owner. He stated the multi- family repurpose and <br />stated impervious cover will be 60-70%. He mentioned they will comply with <br />water quality even though it is not in the recharge zone. Mr. Elizondo stated he <br />is available to answer questions. <br />Mac Jones, the potential buyer, spoke in favor of the project and he stated he <br />will meet the demand of multi -family in the area. Mr. Jones stated he is happy <br />to comply with code and ordinances. <br />Lisa Marie Coppoletta, expressed concern with the landowner not being <br />present. She expressed concern with flooding and that no character studies <br />have been completed. She said it is concerning the development will occur in <br />the 500 -year floodplain. <br />There being no further speakers, the Mayor closed the Public Hearing at 9:11 <br />p.m. <br />A motion was made by Council Member Baker, seconded by Mayor Pro Tem <br />Derrick to deny Ordinance 2021-27. Mayor Hughson noted that the Planning <br />and Zoning Commission denied this item so a motion to approve would have <br />required 6 votes. <br />City of San Marcos Page 14 <br />
