City Council Meeting Minutes April 20, 2021 <br />Deputy Mayor Pro Tem Scott inquired about the alternate approval and would <br />like to compromise. <br />Mayor Hughson asked for confirmation of the Planning and Zoning decision <br />on the alternate approval. Mrs. Mattingly stated they denied the entire 21.22 <br />acre rezone. <br />Council Member Gleason inquired about a motion to approve the alternate <br />approval. Mr. Cosentino stated the motion on the table would have to be <br />removed or the it would have to fail, in order to offer another motion. <br />Mayor Pro Tem Derrick withdrew her second. Council Member Gonzales <br />provided a second to deny. <br />Council Member Gleason would like to consider the 13.3 acres as a majority of <br />the property is outside of the floodway. <br />Mayor Hughson asked about the floodway and floodplain and wanted <br />clarification on this. Ms. Mattingly reviewed the maps and stated the applicant <br />would still need to build to certain standards. <br />Council Member Gleason asked about impervious cover restrictions in CD -5. <br />Richard Reynosa, Assistant Director of Engineering, stated the criteria for <br />floodway and floodplain is the same within the City Limits. The limitation of <br />impervious cover is based on developable areas. Mr. Reynosa stated the <br />development could be around 60% impervious cover. Mr. Elizondo stated they <br />will bring all structures at least two feet above the floodplain and he commends <br />the City on their floodplain policy and will comply with all City standards. His <br />company has built on land such as this in other areas. <br />Council Member Baker stated this development is constrained on all sides by <br />the floodplain. He expressed concerns with future flooding and will support <br />denial. <br />Council Member Gleason stated he lives downstream of this project and is not <br />concerned that he will be flooded out. He will support this project due to the <br />new flood maps and the new land development codes. <br />The motion to deny failed by the following vote: <br />For: 3 - Mayor Pro Tem Derrick, Council Member Baker and Council Member Gonzales <br />City of San Marcos Page 15 <br />
