ESQUIVEL <br />Grantee's Mailing Address (including county): 102 OAKRIDGE DR., SAN MARCOS, HAYS COUNTY, TEXAS <br />78666 <br />Consideration: $10.00 and other good and valuable consideration. <br />Property: Lot Number(s) 1&2 of Block Number 139 Section 1 of the <br />TOWER Addition to the San Marcos' City Cemetery, according to the plat of such <br />addition recorded in Book 4 , Page 312 & 313, of the Plat Records of Hays County, Texas. <br />The Grantor, for the consideration, has granted, sold and conveyed, and by these presents does grant, sell and <br />convey unto Grantee, the Property, to have and to hold the above described premises, together with all and singular <br />the rights and appurtenances thereto in anywise belonging, unto the Grantee, Grantee's heirs and assigns forever. <br />As a part of the Consideration of the Property hereby conveyed, it is agreed and understood: 1) that the Property <br />shall be subject, always, to the restrictions imposed by the City of San Marcos in exercising perpetual care of the <br />Property and all applicable ordinances of the City of San Marcos; and 2) that the Property may be used only for the <br />purpose of interment and for no other purpose, subject to all applicable ordinances of the City of San Marcos. This <br />provision is a covenant running with the land, binding upon the Property, and the present and successive owners <br />thereof, and inuring to the benefit of the Grantor, the City of San Marcos, its successors and assigns, and to the <br />benefit of the remaining lots in the cemetery, and the present and successive owners thereof. <br />Grantor makes this conveyance, and Grantee accepts it, without any warranty as to the subsurface condition of the <br />Property, or the costs of making interments within the Property.
