<br />Property: Lot Number(s) 1 & 2 , of Block Number 139 , Section 1 , of the Tower Addition, acquired by the
<br />City of San Marcos through the estate of A.M. Ramsay, by deed dated October 15,1966, recorded in Vol.216,
<br />pages 626 - 628 . The plat recorded in Vol. 4 pages 312 & 313.
<br />The Grantor, for the consideration, has granted, sold and conveyed, and by these presents does _grant, sell and
<br />convey unto Grantee, the property, to have and to hold the above described premises, together with all and singular
<br />the rights and appurtenances thereto in anywise belonging, unto the Grantee, Grantee's heirs and assigns forever.
<br />As a part of the consideration of the property hereby conveyed, it is agreed and understood that the property shall
<br />be subject, always, to the restrictions imposed by the Governing body of said City of San Marcos in exercising
<br />Perpetual Care of the property. This provision is a covenant running with the land, binding upon the property, and
<br />the present and successive owners thereof, and inuring to the benefit of the Grantor, its successors and assigns, ad
<br />to the benefit of the remaining lots in the cemetery, and the present and successive owners thereof.
<br />Grantor makes this conveyance, and Grantee accepts it without any warranty as to the subsurface condition of the
<br />property, or the costs of making interments within the property. Grantee, and Grantee's successors and assigns,
<br />accept all risks as to such conditions and costs as a part of this transaction.
<br />This deed is executed on behalf of Grantor by its Mayor, and attested by its Secretary, as authorized by an
<br />ordinance passed on August 6, 1924 of record in Vol. 6, at page 154, in the official minutes of Grantor's City
<br />Commission, this the ov— day of November 2002.
