City Council Meeting Minutes August 3, 2021 <br />applicant. The existing project achieved CD -4 zoning approval in October <br />2019. <br />Mayor Hughson opened the Public Hearing at 6:45 p.m. <br />Those who spoke: <br />John David Carson, spoke in favor for the zoning change. He stated 2019 was <br />the first phase of zoning approval. He would like for Council to approve the <br />zoning for the second phase which will be town homes and each unit will be <br />owned. Mr. Carson stated this type of project has not been built in San <br />Marcos, currently eight out of eleven units in phase 1 are reserved. <br />Construction will begin at the end of the year. Phase 2 has eighteen units and <br />four have been reserved with construction to begin at the end of the year. Mr. <br />Carson mentioned the sustainability features that the units have. He noted <br />some of the units are designated as "Live/Work" which some may wish to have <br />a business on the first floor. He is available to answer questions. <br />Sarah Simpson, spoke in favor of the project and is available to answer <br />questions. <br />Lisa Marie Coppoletta, stated this parcel has archaeology artifacts and would <br />like council to add a provision in the land development code for the protection <br />of native American artifacts. She expressed concern that Hunter Road does not <br />drain and she has concerns with future flooding in the area. <br />Mayor Hughson closed the Public Hearing at 6:52 p.m. <br />A motion was made by Council Member Gleason, seconded by Mayor Pro <br />Tem Derrick, to approve Ordinance 2021-62, on the first of two readings. <br />Council Member Baker expressed concern with sustainability and housing with <br />the increase of the project. He stated the applicant has a business that is <br />struggling to rent space and is concerned with how affordable it be for small <br />businesses. He inquired about native American artifacts protected federally <br />and asked for an archeological study. Mr. Cosentino stated Council can <br />include provisions or add a clause to the agreement for a study to be done or a <br />petition but it is up to Council. Mayor Hughson asked what would be the state <br />regulations on the criteria for an artifact study to be done? Mr. Cosentino <br />stated wording can be added to the agreement stating upon the completion of <br />archeological study of artifacts in compliance with applicable state regulations. <br />Ms. Moyer stated when city complies with archeological requirements there is <br />City of San Marcos Page 8 <br />
