<br />23 <br /> <br />Special Meeting <br /> <br />January 18, 1982 <br /> <br />Page 2 <br /> <br />MAINTENANCE CRITERIA; PROVIDING FOR THE GRANTING <br />OF VARIANCES; PROVIDING AN APPEAL PROCESS; PRO- <br />VIDING PENALTIES; PROVIDING FOR CONFLICT WITH <br />OTHER ORDINANCES; PROVIDING FOR SEPARABILITY AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mrs. Norris moved to approve the Ordinance on first reading and Mrs. <br />Mendez seconded the motion. City Manager A. C. Gonzalez advised the <br />Council that Mr. Troy Ulmann from the City of Austin, who had worked <br />on ordinances of this type regarding Barton and Williamson Creeks, <br />had been consulted and certain criteria placed in the Ordinance at <br />his suggestion. Kelley Kilber advised the Council he felt the Or- <br />dinance was too restrictive regarding the 15% slope criteria. The <br />Council voted unanimously in favor of approval of the Ordinance on <br />first reading. <br /> <br />Mayor Craddock introduced for consideration an Ordinance on first <br />reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ADOPTING A CHAPTER TO BE ADDED TO <br />THE CODE OF ORDINANCES OF SAID CITY, SAID CHAPTER <br />TO BE ENTITLED "LANDSCAPING AND BUFFERING" AND TO <br />BE NUMBERED CHAPTER 14 1/2, DEFINING TERMS; SETTING <br />REQUIREMENTS FOR THE AMOUNT OF LAND WHICH MUST BE <br />DEVOTED TO LANDSCAPING AND BUFFERING; EXEMPTING <br />THE CENTRAL BUSINESS DISTRICT FROM SAID REQUIRE- <br />MENTS FOR THE PLANTING AND/OR PRESERVATION OF TREES; <br />PROVIDING FOR THE REVOCATION OF SAID CREDITS IF SAID <br />TREES DIE; DESCRIBING APPLICABILITY TO NEW AND EXIST- <br />ING DEVELOPED AREAS; SETTING STANDARDS FOR THE INSTAL- <br />LATION OF LANDSCAPING AND BUFFERING AREAS; ESTABLISH- <br />ING PLANTING CRITERIA; REQUIRING A PLOT PLAN; EXEMPT- <br />ING SINGLE-FAMILY DETACHED RESIDENTIAL PROPERTY FROM <br />THE REQUIREMENTS FOR PROVISION OF A PLOT PLAN; GRANT- <br />ING THE PLANNING AND ZONING COMMISSION POWER TO GRANT <br />EXCEPTIONS IN SPECIFIED CASES; ASSIGNING ENFORCEMENT <br />RESPONSIBILITIES; PROVIDING FOR AN APPEALS PROCESS; <br />PROVIDING FOR SEPARABILITY; PROVIDING FOR THE FILING <br />OF RULES, REGULATIONS, STANDARDS AND SPECIFICATIONS; <br />PRESCRIBING PENALTIES AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Brown moved for the approval of the Ordinance on first reading and <br />Mrs. Norris seconded the motion. City Manager A. C. Gonzalez stated <br />this would require all property development to provide 20 percent land- <br />scaping or a credit for the installation or keeping of existing trees. <br />The credit would be allowed if one-half the radius underneath the trees <br />was left undeveloped. The requirement would exempt "R-l" (Single- <br />Family Residential Dwelling) zoning. Mr. Harvey Ginsburg requested <br />the Council to provide some provision that natural waterways be left <br />in their natural state. Mrs. Norris moved the wording in the Hillside <br />Development Ordinance on Page 6, Section c. (i) - "Natural drainage <br />patterns shall be preserved whenever possible", be added in the gen- <br />eral requirements under Section 14 1/2 - 5 of this Ordinance and Mr. <br />Brown seconded the motion. <br /> <br />The City Attorney then advised the Council that she had been instructed <br />to exempt the Central Business District from the requirements cited in <br />14 1/2-4A(1) but through error had not done so and suggested this amend <br />ment be considered by the Council. <br /> <br />Mr. Kreczmer then suggested that Mrs. Norris' motion for amendment to <br />Section 14 1/2 - 5 be more specific. After some discussion, Mayor <br />Craddock requested Mrs. Norris to rephrase her motion. Mrs. Norris <br />then stated that the water needs to be redirected at timæ for preven- <br />tion of flooding buildings, such as in the case of Crockett School <br />where the water was rechanneled. Mrs. Norris then rephrased her mo- <br />tion to amend 14 1/2 - 5 to read "Drainage ways shall be maintained <br />in their natural state insofar as possible", and Mr. Brown seconded <br />the motion, which passed unanimously. <br />
