City Council Meeting Minutes November 16, 2021
Against: 0
Absent: 2 - Derrick and Council Member Gonzales
23. Consider approval, by motion, and hold discussion regarding the proposed 2022 City Council
Meeting Schedule, and provide direction to Staff.
A motion was made by Mayor Hughson, seconded by Mayor Pro Tem Scott,
to table item #23 until after item #25.
The motion carried by the following vote:
For: 6 - Mayor Hughson, Council Member Baker, Mayor Pro Tem Scott, Deputy Mayor Pro
Tem Garza, Council Member Gleason and Council Member Prather
Against: 0
Absent: 2 - Derrick and Council Member Gonzales
24. Hold discussion regarding archaeological surveys and artifact preservation strategies for public
and private development projects and provide direction to the City Manager.
Shaun Condor, Assistant Director of Capital Improvements, provided a brief
introduction regarding the Capital Improvement Project (CIP) archeological
review process on State and Federal requirements.
He stated under State requirements the city is required to notify the Texas
Historical Commission (THC) prior to commencing any project on public land
that may affect archeological sites that involve five or more acres of ground
disturbance; 5,000 or more cubic yards of earth moving, occur in a historic
district or other designated historic site; or affect a recorded archeological site.
The city hires a consultant that does a desktop survey that is submitted to the
THC with their recommendation. He mentioned that THC has 30 days to
concur or provide an alternative recommendation.
Mr. Condor mentioned Federal requirements are similar to the State
requirements but the difference is that it is required for compliance in Section
106 of the National Historic Preservation Act of 1966. He stated the
archeological review is still coordinated through the THC and all projects,
regardless of funding, will be required to meet the same federal and state
requirements. The state and federal process just document the process
differently. He stated the city will comply with the THC recommendation on
both federally & non -federally funded projects.
Amanda Hernandez, Assistant Director of Planning and Development Services
stated the code does not include archeological review process for private
City of San Marcos Page 14
