129

CITY COUNCIL
REGULAR MEETING
September 13, 1982
Page $10

Mr. Kreczmer stated that it seems that one individual is moving
in buildings on the corner of Porter and Mitchell Streets which
are substandard. Mr. Gonzalez stated that he is under a time
frame for bringing them to standard, and he will not receive
a Certificate of Occupancy until such time as they meet all
code requirements. The Building Inspector has looked at the
internal structure and lumber of the buildings and has determined
them to be of good quality. It is conceivable that if they are
not brought to standard, the City will find it necessary to
utilize this very code. This code basically refers to structures
lying vacant with nothing being done to them, no improvements
planned. Mr. Kreczmer was concerned with Austin getting rid of
these buildings, and San Marcos is taking them. Mrs. Mendez
spoke to the room height requirement, and added that this was
the reason Mr. Kraus could not bring his buildings into the
city limits. Mr. Farr was under the impression that there is
an eight-foot (8') height requirement. Ms. Wickersham stated
that there is no City Building Inspector since Jack Major left.
There being no further discussion, Mrs. Norris moved the ordinance
be approved and adopted on third and final reading. Mrs. Mendez
provided the second, and the motion passed unanimously.

Mayor Craddock introduced for consideration approval of an
ordinance on third and final reading, the caption of which
was read as follows:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SAN MARCOS, TEXAS, AMENDING THE CODE OF
ORDINANCES OF SAID CITY TO SET STANDARDS
FOR THE APPOINTMENT OF MEMBERS OF THE CITY
PLANNING COMMISSION AND CITY ZONING COMMISSION,
TO DESCRIBE CHARACTERISTICS AND/OR AREAS OF
EXPERTISE OF EACH MEMBER ON EACH COMMISSION
AND DECLARING AN EFFECTIVE DATE.

Mr. Brown moved the ordinance be approved and adopted on third
and final reading. Mrs. Norris provided the second, and the
motion passed unanimously.

Mayor Craddock introduced for consideration approval of an
ordinance on third and final reading, the caption of which
was read as follows:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF
THAT ORDINANCE WHICH REGULATES AND RESTRICTS
THE LOCATION AND USE OF BUILDINGS, STRUCTURES
AND LAND, DATED SEPTEMBER 29, 1980 (VOL~ 54)
BY ZONING LOT NO. EIGHT (8) IN BLOCK NO. TWO
(2) OF THE LINDSEY AND HARVEY ADDITION, A/K/A
503 HOPKINS AND 504 HARVEY, FROM "D" (MULTI-
FAMILY DWELLING DISTRICT) TO "C" (COMMERCIAL
DISTRICT).

Mrs. Norris asked if all concerns had been met. Mr. Gonzatez
stated that an easement is on file. Mayor Craddock asked if
the parking requirements had been met. Mr. Gonzalez stated
that this is addressed during the permitting process. He added
that that area will have traffic problems, but the applicant
has participated to the extent which he can. He will have to
meet all code requirements. Mrs. Norris spoke to the yellow
curbing along LBJ at its intersection with Chestnut which is
violated daily. The Chestnut Center being built has enough
parking to address the shell which is being built. It any
use is requested which requires additional parking, that will
have to be provided or the use will not be allowed. Mrs.
Norris moved that the ordinance be approved and adopted on
third and final reading. Mrs. Mendez provided the second,
and the motion passed unanimously.
