130 <br /> <br />CITY COUNCIL <br />REGULAR MEETING <br />September 13, 1982 <br />Page ~11 <br /> <br />Mayor Craddock introduced for consideration a Resolution, <br />the caption of which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF A LEASE BETWEEN SAID CITY AND <br />W. A. HIBBERT OF PREMISES LOCATED AT SAN <br />MARCOS MUNICIPAL AIRPORT; AUTHORIZING THE <br />MAYOR OF SAID CITY TO EXECUTE SAID LEASE; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Brown moved the Resolution be approved and adopted with <br />the change of the rate to ten cents (10¢) rather than five <br />cents (5¢) to keep the rates consistent. Mrs. Norris provided <br />the second, and the motion passed unanimously. Mr. Kreczmer <br />asked why the lease is for ninety (90) days subject to renewal <br />(#4 on page 2). Mr. Gonzalez could not answer that question. <br /> <br />Mayor Craddock introduced the consideration of extension of <br />utility service outside the city limits to Bob Hyatt. Mr. <br />Gonzalez stated that there is a short form for the developer <br />to fill out. This is a short line to be extended. Mayor <br />Craddock asked the present policy of the City. Mr. Gonzalez <br />stated that the extension policy addresses all line extensions <br />both outside and inside the city limits. The owner pays for <br />the extension with the exception that the first 100 feet for <br />each permanent structure developed is paid by the City. Also, <br />the developer pays for lines up to eight inches (8") with the <br />City paying for any size over that. This request is for one (1) <br />residential structure, so the City pays for the first 100 feet. <br />Mr. Kreczmer asked what rate the owner will pay. Mr. Gonzalez <br />stated that utility rates outside the city limits are double. <br />Mr. Boeker explained the existing situation in that area. There <br />are other houses in that general area on city water. Mr. Farr <br />asked if utilities had been extended outside the city limits <br />before, and Mr. Gonzalez cited the Hunter Road extension and the <br />Mosscliff extension. Mr. Brown asked if the owner must be <br />annexed. Mr. Gonzalez advised that the owner must make available <br />by petition their proposal for annexation, and it is up to the <br />City Council if they so wich to annex. The petition is then <br />placed on file. Mr. Hyatt stated that he would not do that. <br />Mr. Brown pointed out that this was part of the requirements <br />of the policy which had been in effect for more than one (1) year. <br />Mr. Hyatt pointed out that he has done everything he has been <br />asked to do, and added that he was not made aware of this <br />requirement. Mr. Boeker stated that the City always asks <br />for voluntary annexation at the time of extensions, and added <br />that he did not know why this was not brought to Mr. Hyatt's <br />attention. Ms. Edwards asked if his property was adjacent to <br />the current city limits, and Mr. Hyatt stated that it is. Mrs. <br />Mendez asked for an estimate of the City's share of the cost of <br />this extension. Mr. Boeker stated that it would be about $169.00 <br />for both labor and materials. Mr. Farr stated that the request <br />for annexation is a standing policy of the City, and perhaps Mr. <br />Hyatt needs more time for consideration of this requirement. <br />Mr. Farr then moved that the item be tabled. Mrs. Mendez provided <br />the second, and the motion passed unanimously. <br /> <br />Mrs. Norris then moved that the Council adjourn at 9:50 p.m. into <br />Executive Session pursuant to Article 6252-17, ~2(f), V.A.C.S. to <br />discuss landfill acquisition. Mr. Kreczmer provided the second, <br />and the motion passed unanimously. <br /> <br /> <br />
