130 CITY COUNCIL REGULAR MEETING September 13, 1982 Page ~11 Mayor Craddock introduced for consideration a Resolution, the caption of which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A LEASE BETWEEN SAID CITY AND W. A. HIBBERT OF PREMISES LOCATED AT SAN MARCOS MUNICIPAL AIRPORT; AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE SAID LEASE; AND DECLARING AN EFFECTIVE DATE. Mr. Brown moved the Resolution be approved and adopted with the change of the rate to ten cents (10¢) rather than five cents (5¢) to keep the rates consistent. Mrs. Norris provided the second, and the motion passed unanimously. Mr. Kreczmer asked why the lease is for ninety (90) days subject to renewal (#4 on page 2). Mr. Gonzalez could not answer that question. Mayor Craddock introduced the consideration of extension of utility service outside the city limits to Bob Hyatt. Mr. Gonzalez stated that there is a short form for the developer to fill out. This is a short line to be extended. Mayor Craddock asked the present policy of the City. Mr. Gonzalez stated that the extension policy addresses all line extensions both outside and inside the city limits. The owner pays for the extension with the exception that the first 100 feet for each permanent structure developed is paid by the City. Also, the developer pays for lines up to eight inches (8") with the City paying for any size over that. This request is for one (1) residential structure, so the City pays for the first 100 feet. Mr. Kreczmer asked what rate the owner will pay. Mr. Gonzalez stated that utility rates outside the city limits are double. Mr. Boeker explained the existing situation in that area. There are other houses in that general area on city water. Mr. Farr asked if utilities had been extended outside the city limits before, and Mr. Gonzalez cited the Hunter Road extension and the Mosscliff extension. Mr. Brown asked if the owner must be annexed. Mr. Gonzalez advised that the owner must make available by petition their proposal for annexation, and it is up to the City Council if they so wich to annex. The petition is then placed on file. Mr. Hyatt stated that he would not do that. Mr. Brown pointed out that this was part of the requirements of the policy which had been in effect for more than one (1) year. Mr. Hyatt pointed out that he has done everything he has been asked to do, and added that he was not made aware of this requirement. Mr. Boeker stated that the City always asks for voluntary annexation at the time of extensions, and added that he did not know why this was not brought to Mr. Hyatt's attention. Ms. Edwards asked if his property was adjacent to the current city limits, and Mr. Hyatt stated that it is. Mrs. Mendez asked for an estimate of the City's share of the cost of this extension. Mr. Boeker stated that it would be about $169.00 for both labor and materials. Mr. Farr stated that the request for annexation is a standing policy of the City, and perhaps Mr. Hyatt needs more time for consideration of this requirement. Mr. Farr then moved that the item be tabled. Mrs. Mendez provided the second, and the motion passed unanimously. Mrs. Norris then moved that the Council adjourn at 9:50 p.m. into Executive Session pursuant to Article 6252-17, ~2(f), V.A.C.S. to discuss landfill acquisition. Mr. Kreczmer provided the second, and the motion passed unanimously.
