126 <br /> <br />CITY COUNCIL <br />REGULAR MEETING <br />September 13, 1982 <br />Page ~7 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF <br />THAT ORDINANCE WHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) <br />BY ZONING 6.03 ACRES OF LAND IN THE J. M. <br />VERAMENDI LEAGUE NO. ONE, A/K/A 1222 REDWOOD <br />ROAD, FROM "AO" (AGRICULTURAL-OPEN SPACE DISTRICT) <br />TO "OP" (OFFICE-PROFESSIONAL DISTRICT). <br /> <br />Mr. Brown asked who does and who pays for the required utility <br />boring across the street. Mr. Gonzalez stated that the extention <br />policy requires the developer to pay for this. Mr. Brown asked <br />about the traffic consideration. Mr. Gonzalez stated that the <br />current right-of-way is 100 feet and the Highway Department would <br />like 120 feet. He stated that he would check with the developer <br />before the third reading on a right-of-way dedication. Mrs. Norris <br />moved that the ordinance be approved on first reading. Mr. Farr <br />provided the second, and the motion passed unanimously. <br /> <br />Mayor Craddock introduced for consideration approval of an ordinance <br />on first reading, the caption of which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, DECLARING THE NECESSITY <br />OF ACQUIRING 7420 SQUARE FEET, MORE OR LESS, <br />OUT OF TRACT TEN (10), OF THE A. W. WITHERS <br />SUBURBAN TRACTS, A SUBDIVISION IN THE CITY OF <br />SAN MARCOS, HAYS COUNTY, TEXAS FOR A PUBLIC <br />PURPOSE; DESCRIBING THE PROJECT FOR WHICH SAID <br />PROPERTY IS TO BE ACQUIRED; DESCRIBING-SAID <br />PROPERTY; AUTHORIZING SAID CONDEMNATION; AUTHORIZING <br />THE CITY ATTORNEY TO INSTITUTE CONDEMNATION <br />PROCEEDINGS AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mrs. Mendez moved the ordinance be approved on first reading. <br />Mr. Farr provided the second. Mr. Brown suggested the motion <br />be amended on staff recommendation to pass the ordinance on <br />emergency so the work may commence. Ms. Edwards stated that <br />this can be done, but her office has questions which require <br />clarification before a statement can be filed. Mrs. Mendez <br />amended her motion to reflect the amendment. The votes were <br />cast as follow: <br /> <br />AYES: <br />NAYS: <br /> <br />Brown, Farr, Kreczmer, Mendez <br />Craddock, Norris <br /> <br />The motion did not pass, approving the ordinance on an emergency <br />basis. Mr. Brown then moved the orginance be approved on first <br />reading and if all concerns are cleared it could be passed on <br />emergency at a later date. Mr. Farr provided the second, and <br />the motion passed unanimously. <br /> <br />Mayor Craddock introduced for consideration approval of an <br />ordinance on second reading, the caption of which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, VACATING AND ABANDONING <br />A PORTION OF DAVID STREET IN SAID CITY, PROVIDING <br />FOR THE REVERSION OF FEE IN SAID LAND AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Kreczmer moved the ordinance be approved on second reading. <br />Mr. Brown provided the second, and the motion passed unanimously. <br /> <br /> <br />
