146 <br /> <br />Regular Meeting <br /> <br />September 27, 1982 <br /> <br />Page 4 <br /> <br />Mrs. Mendez moved to approve the Ordinance on second reading and <br />Mrs. Norris seconded the motion, which passed unanimously. <br /> <br />Mr. Brown introduced for consideration approval of an Ordinance on <br />second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, DECLARING THE NECESSITY OF ACQUIRING <br />7420 SQUARE FEET, MORE OR LESS, OUT OF TRACT TEN (10), <br />OF THE A. W. WITHERS SUBURBAN TRACTS, A SUBDIVISION <br />IN THE CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, FOR A <br />PUBLIC PURPOSE; DESCRIBING THE PROJECT FOR WHICH SAID <br />PROPERTY IS TO BE ACQUIRED; DESCRIBING SAID PROPERTY; <br />AUTHORIZING SAID CONDEMNATION; AUTHORIZING THE CITY <br />ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mrs. Norris moved to approve the Ordinance on second reading and Mr. <br />Kreczmer seconded the motion, which passed unanimously. <br /> <br />Mr. Brown introduced for consideration the adoption of an Ordinance <br />on third and final reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, VACATING AND ABANDONING A PORTION OF <br />DAVID STREET IN SAID CITY, PROVIDING FOR THE REVER- <br />SION OF FEE IN SAID LAND AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mr. Farr moved for the adoption of the Ordinance on third and final <br />reading and Mrs. Mendez seconded the motion, which passed unanimously. <br /> <br />Mr. Brown introduced for consideration the adoption of an Ordinance <br />on third and final reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE GENERAL ZONING ORDINANCE <br />OF SAID CITY TO INCLUDE A DISTRICT TO BE KNOWN AS THE <br />CENTRAL BUSINESS AREA IN WHICH SHALL BE PROHIBITED <br />BARS, NIGHTCLUBS, RESTAURANTS SELLING ALCOHOLIC BEVER- <br />AGES FOR ON PREMISE CONSUMPTION AND MOBILE HOMES AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mrs. Norris moved for the adoption of the Ordinance on third and final <br />reading and Mr. Kreczmer seconded the motion. Mr. Moore said he opposed <br />adoption of the Ordinance. He said the Ordinance would not effectively <br />deal with the parking problems of the downtown area. There needs to be <br />better enforcement if there is a problem with intoxicated patrons on <br />the streets of the Central Business Area, and the Ordinance would <br />create an unfair market advantage. Mrs. Norris asked City Attorney <br />Barbara Edwards about the conditional use permitting. She indicated <br />it was tied in with the state permit. If a tavern was sold from one <br />individual to another, a new permit would need to be applied for. <br />Other types of commercial businesses do not require such permitting. <br />On roll call the following vote was recorded: <br /> <br />AYE: Brown, Farr, Kreczmer, Norris. <br /> <br />NAY: Moore. <br /> <br />ABSTAIN: Mendez. <br /> <br /> <br />
