147 <br /> <br />Regular Meeting <br /> <br />September 27, 1982 <br /> <br />Page 5 <br /> <br />Mr. Brown introduced for consideration the adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS <br />OF A FIRE PROTECTION AGREEMENT BETWEEN SAID CITY AND <br />HAYS COUNTY FOR THE PROVISION OF FIRE PROTECTION TO <br />PERSONS AND PROPERTY LOCATED IN HAYS COUNTY AND OUT- <br />SIDE THE CORPORATE LIMITS OF THE CITY OF SAN MARCOS; <br />AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE SAID <br />AGREEMENT ON BEHALF OF SAID CITY AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mrs. Norris moved for the adoption of the Resolution with the follow- <br />ing amendment to be made on Page 2, Section V of the Fire Protection <br />Agreement - Change the second sentence to read as follows: "Said <br />volunteers shall have rights of access pursuant to departmental <br />policy to the communication system of City maintained by City for <br />use by the City of San Marcos Fire Department, said rights to be <br />equal to those available to the City of San Marcos Fire Department." <br />Mr. Brown seconded the motion. Mr. Brown then moved that Section <br />III of the Fire Protection Agreement be amended to delete the dona- <br />tion of Firetruck ~309 to the County and Mr. Moore seconded the mo- <br />tion. Judge Burnett said the County Commissioners had just that morn- <br />ing agreed to pay the City $15,000.00, but it had been a difficult <br />decision to pass. He feared the deletion of the donation of the <br />#309 Fire Truck to the County would not be approved. He said the <br />County's trucks would be available for the City's use when needed. <br />Mr. Moore stated he thought the donation of the firetruck would be <br />spreading the trucks too thin and for the truck to be centrally <br />located would inure to the benefit of the citizens. Mr. Farr asked <br />Judge Burnett if the donation of #309 to the County wouid relieve the <br />City's burden. Judge Burnett replied it would be of great benefit <br />with structure fires. Mr. Farr asked Judge Burnett if he would be <br />interested in a per call rate (averaging out to be approximately <br />$1,000.00 per call). Oscar Carpenter said the #309 firetruck was <br />the only brush truck, was purchased approximatley 7 years ago for <br />$25,000.00 and was 75% depreciated. Mr. Moore said he would like <br />for the City to be good neighbors but that we could not afford to <br />offer the protection needed with the agreement wanted by the County. <br />Mr. Brown withdrew his motion and Mr. Moore his second for the dele- <br />tion of the donation of the firetruck to the County. Mr. Farr then <br />moved to amend the Fire Protection Agreement in Section III to loan <br />~309 to the County for the term of this agreement and Mrs. Mendez <br />seconded the motion. On roll call the following vote was recorded: <br /> <br />AYE: Brown, Farr, Kreczmer, Mendez. <br /> <br />NAY: Moore, Norris. <br /> <br />ABSTAIN: None. <br /> <br />The Council then voted on the adoption of the Resolution with Mrs. Nor- <br />ris' amendment. On roll call the following vote was recorded: <br /> <br />AYE: Brown, Farr, Kreczmer, Mendez, Norris. <br /> <br />NAY: Moore. <br /> <br />ABSTAIN: None. <br /> <br />(See minutes of October 11, 1982, repealing this Resolution and Agree- <br />ment). <br /> <br /> <br />
