EXHIBIT 1 <br />CITY OF SAN MARCOS <br />BLANCO GARDENS DRAINAGE IMPROVEMENT PROJECT <br />CHANGE IN SERVICES FOR <br />ADDITIONAL CONSTRUCTION PHASE SERVICES <br />SCOPE OF SERVICES <br />sorted, removing all live and dead shell material. The minimum number of samples requested is <br />based on the rate of 1 quadrat per 5 m2 of delineated area of the cells that met the above triggers. <br />A minimum of 50 quadrat samples shall be collected regardless of size of the area within the <br />Salvage Zone that met the above triggers. Phase II quantitative survey results will be utilized to <br />arrive at anticipated take of mussel species for the project. <br />C. Salvage Event for Listed Mussel Species (if needed): <br />If state or federally listed mussel species are located during the Phase I or Phase II effort, CMEC <br />will perform the salvage and relocation of mussels from the salvage area of the proposed project. <br />A multiple pass depletion effort, with a minimum of two passes, shall be made through each cell <br />until less than 10 percent of the original number of live common mussels collected are recovered <br />on the final pass. If a listed species is found during the final pass of a cell or transect, an additional <br />pass will be completed in that cell or transect regardless of the percentage threshold achieved <br />during that pass. Additional passes will only be requested in cells or transects that have not <br />reached the necessary threshold or where listed species were collected. Other cells that have <br />met the threshold will require no further effort. All collected mussels will be relocated. Following <br />completion of salvage effort, CMEC will prepare a draft and final survey report summarizing the <br />results of the survey and relocations. <br />D. Survey and Relocation Draft and Final Report: <br />CMEC will prepare reports detailing the mussel survey and relocation efforts. Reporting criteria <br />will be consistent with the ARRP and the current TPWD guidance. <br />E. Salvage Event for Aquatic Species (Excluding Mussels): <br />After completion of Task land installation of the cofferdam, relocations methods for freshwater <br />aquatic species will be completed for the remainder of the project area as specified by the TPWD <br />Kills and Spills Team during the application process and outlined in the approved ARRP. CMEC <br />will perform the relocation effort before and during the dewatering process. Once the water depth <br />reaches approximately 24 inches relocation of aquatic resources will begin by dip netting, seining, <br />and collection by hand. Species will be relocated as described in the ARRP. <br />CMEC assumes that no more than two mobilizations (i.e., two separate days of draw -down <br />operations) would be required. In the event that the cofferdam is overtopped by flood water or is <br />otherwise breached, any additional environmental services required by TPWD, USACE, or the <br />USFWS may require an additional scope and fee agreement. <br />Following completion of the relocation effort, CMEC will prepare a draft and final survey report <br />summarizing the results of the survey and relocations. The report will include graphics showing <br />the extent of the areas surveyed and the relocation area, a table showing the number of live <br />individuals of each species gathered in the survey area, and representative photographs of each <br />species encountered. <br />CMEC will perform these efforts under the authority of Texas Parks and Wildlife Department <br />(TPWD) Scientific Research Permit SPR -0691-409. CMEC will be responsible for collecting, <br />temporarily holding, and relocating native fishes, freshwater mussels (Unionidae), aquatic <br />reptiles, and amphibians. <br />F. Incidental Aqency Coordination: <br />CMEC understands that TPWD, USACE, and USFWS will require notification and reporting on <br />all facets of the project's construction -phase services.
