City Council Meeting Minutes April 5, 2022 <br />to enter Executive Session for legal advice under Section 551.071. The motion <br />carried by the following vote: <br />For: 6 - Mayor Hughson, Council Member Gonzales, Mayor Pro Tem Scott, Deputy Mayor <br />Pro Tem Garza, Council Member Prather and Council Member Gleason <br />Against: 1 - Council Member Baker <br />EXECUTIVE SESSION <br />23. Executive Session in accordance with the following: <br />A. Sec. §551.071 of the Texas Government Code: Consultation with Attorney: To receive a <br />briefing on pending litigation, to wit: Civil Action No. 1:21 -CV -00568 -RP; In the United States <br />District Court; Western District of Texas; Eric Cervini, Wendy Davis, David Gins, and <br />Timothy Holloway v. Chase Stapp, Brandon Winkenwerder, Matthew Daenzer, and City of <br />San Marcos <br />B. Sec. §551.072 of the Texas Government Code: Real Property: to receive a briefing and <br />deliberate on Blanco Riverine Acquisitions <br />Mayor Hughson stated Council completed Executive Session at 12:02 am. <br />Mayor Hughson stated Executive Session items are also posted on the 3:00 <br />Work Session agenda and that the items under Executive Session were <br />completed during the Work Session. Therefore, this Executive Session item <br />is not needed this evening. <br />DIRECTION/ACTION FROM EXECUTIVE SESSION <br />24. Consider action, by motion, or provide direction to Staff regarding the following Executive <br />Session item held during the Work Session and/or Regular Meeting: <br />A. Sec. §551.071 of the Texas Government Code: Consultation with Attorney: to seek <br />advice of legal counsel regarding flood prevention and watershed protection measures <br />applicable in the city's extraterritorial jurisdiction <br />Mayor Hughson stated for item A council received a briefing and for item B, <br />that council provided direction to staff. She stated that during the Executive <br />Session held for item #20, council provided direction to staff. <br />VI. Question and Answer Session with Press and Public. <br />None <br />VII. Adjournment. <br />A motion was made by Mayor Pro Tem Scott, seconded by Council Member <br />Prather, to adjourned the regular meeting of the City Council on Wednesday, <br />April 6, 2022 at 12:06 a.m. The motion carried by the following vote: <br />For: 7 - Mayor Hughson, Council Member Baker, Council Member Gonzales, Mayor Pro <br />Tem Scott, Deputy Mayor Pro Tem Garza, Council Member Prather and Council <br />Member Gleason <br />City of San Marcos Page 13 <br />
