City Council Meeting Minutes April 5, 2022 <br />Planning and Zoning Commission (PZC) with the restrictive covenant for <br />approval. Ms. Mattingly stated this item can be taken back to PZC. <br />Mayor Hughson would like the Whisper Committee to review this item. Can <br />this item be brought back as a new case? Mr. Cosentino stated the developer <br />may need to fill out a new application. Mayor Hughson doesn't want the <br />developer to pay the application fee or recommends we will refund the fee. Ms. <br />Mattingly stated staff can revise the application per applicant request and <br />bring it back to PZC to update the staff report. <br />A motion was made by Mayor Hughson, seconded by Council Member <br />Gleason, to postponed Ordinance 2022-26, allow the development to modify <br />the application, and defer this item to the Whisper Committee and then send <br />back to Planning and Zoning Commission for a new application with the <br />restrictive covenants. The motion carried by the following vote: <br />For: 7 - Mayor Hughson, Council Member Baker, Council Member Gonzales, Mayor Pro <br />Tem Scott, Deputy Mayor Pro Tem Garza, Council Member Prather and Council <br />Member Gleason <br />Against: 0 <br />13. Receive a staff presentation and hold a public hearing to receive comments for or against <br />Ordinance 2022-27, amending the Official Zoning Map of the City in Case ZC-22-08, by <br />rezoning approximately 5.01 acres of land generally located at the intersection of E McCarty <br />Lane and Hwy 123 from "LI", Light Industrial Distric to TM", Commercial District, or, subject to <br />the consent of the owner, another less intense zoning district classification, including <br />procedural provisions; providing an effective date, and consider approval of Ordinance 2022-27 <br />on the first of two readings. <br />Shannon Matting, Director of Planning and Development Services, provided a <br />presentation regarding the rezoning of 5.01 acres located at 3200 Block <br />Highway 123. She stated the proposed development is a Business Park. <br />Mayor Hughson opened the Public Hearing at 7:19 p.m. <br />Those who spoke: <br />Ed Theriot, spoke in favor of this project, he stated the reduction was from 7 <br />acres and prior to the Planning and Zoning meeting the front of FM110 it is <br />already zoned to Commercial. He is available to answer questions. <br />There being no further speakers, Mayor Hughson closed the Public Hearing at <br />7:20 p.m. <br />A motion was made by Mayor Pro Tem Scott, seconded by Council Member <br />City of San Marcos Page 6 <br />
