C. No special standards, not normally applicable in the City or ETJ, shall apply. <br />1.05 Application Procedures <br />A. Development of the Property shall be governed by the following: <br />Z. All procedures outlined in the SMDC and City of San Marcos Code of <br />Ordinances, as they exist on the Effective Date of this Agreement, shall <br />apply, <br />2. Plat Approval: The Parties agree that the approved land uses in each final <br />plat of portions of the Property shall be consistent with the Conceptual Land <br />Use Plan and Exhibit "B" attached hereto. <br />3. Parkland Dedication: <br />i. Parkland dedication requirements may be satisfied by providing <br />publicly accessible private parkland which are privately owned and <br />maintained_ Any private paridand and amenities that are not publicly <br />accessible shall not count towards meeting the City's parkland <br />dedication requirements. The amount and location of such private <br />parkland may be approved administratively. <br />ii. Parkland dedication requirements may be satisfied by paying a fee <br />in lieu of dedication which may be approved administratively, <br />W. in no case shall the parkland dedication or fee in lieu be less than <br />that required by Chapter 3, Article 10 of the SMDC. <br />4. Third Party Inspections: <br />i. Environmental & Erosion Control: All erosion and sedimentation <br />controls shall be monitored and maintained at all times during the <br />construction process, and shall be inspected biweekly by a qualified, <br />third -party engineering inspector, as approved by the City. Such <br />inspection results shall be provided to the City following each <br />inspection. <br />a. For purposes of this section, the term construction shall <br />include all phases of development, from the movement of dirt <br />for infrastructure to final Certificate of Occupancy. <br />ii. Building Inspections: The City of San Marcos Fire Prevention <br />Division shall provide inspections of all Multifamily and Commercial <br />buildings at no additional cost to the Owner, For all other building <br />types, unless an alternative is mutually agreed upon by the City and <br />Owner, building inspections conducted during the permitting process <br />and through receipt of certificate of occupancy shall be conducted by <br />a qualified, third -party inspection service, as approved by the City. <br />Such inspections shall be consistent with City inspection practices. <br />Inspection results shall be provided in the MyPermitNow system, or <br />subsequent system, to the City following each inspection. <br />
