ill. The City of San Marcos shall provide inspection of all public <br />improvements. <br />iv. Cost for inspections shall be the responsibility of the Owner. <br />9.06 Public Facilities Schedule & Financing <br />A. An Out of City Utility Connection / Extension application will not be required for the <br />development of this Property provided that the terms of this Agreement are met. <br />B. The Owner shall be responsible for the payment of all costs associated with the <br />extension and improvements of the infrastructure required to properly serve <br />development of the Property. <br />C. Provisions for providing Water Service to the Property <br />1. City of San Marcos is the water service provider and has the necessary <br />Capacity to serve the Property. <br />D. Provisions for providing Wastewater Service to the Property <br />1. City of San Marcos is the Wastewater service provider and has the <br />necessary CCN to serve the Property. <br />E. Provisions for providing Electric Service to the Property <br />1. Bluebonnet Electric is the electric service provider and has the necessary <br />capacity to serve the Property. <br />2. The Property is not currently within the City of San Marcos Electric Utility <br />Service Area; however, the San Marcos Electric Utility Roadway Lighting <br />Standards will apply. <br />1.08 Annexation <br />A. Upon approval of this Agreement, Owner agrees to full purpose annexation of the <br />Property. Concurrent with annexation of the Property, the Owner shall initiate a <br />zoning change to establish a zoning district that is consistent with the terms and <br />conditions of this Agreement. Owner agrees to submit applications for Annexation <br />and Zoning of the entire 20.07 -acre Property within 90 days of the Effective Date <br />of this Agreement. City agrees to institute annexation proceedings within ninety <br />(90) days of the receipt an application for Annexation. <br />SECTION 2: MISCELLANEOUS PROVISIONS <br />2.01 Term <br />A. The term of this Agreement will commence on the Effective Date and continue for <br />thirty (30) years thereafter ("Initial Term"), unless sooner terminated under this <br />
