Contractors Responsibilities <br /> The Contractor will provide all labor,supervision,equipment,tools,safety equipment,transportation,verification, <br /> expertise, and all other necessary ancillary items for proper execution and completion of services requests. The <br /> materials and services provided by the Contractor will comply with all current Federal, State,and local laws,City <br /> ordinances,rules, and regulations. <br /> Services are required to include the following through the duration of the contract: <br /> 1. Contractor will complete and maintain pre-employment background checks as defined by the Texas <br /> Department of Licensing and Regulation for Transportation Network Companies. Contractor will follow <br /> the Disqualifying conventions for employment as defined by the Texas Department of Licensing and <br /> Regulation for Transportation Network Companies. <br /> 2. All services to be provided will be available in English and Spanish. <br /> 3. Circulating shuttle route(s)with flexibility as directed by the City. <br /> 4. Provide an electronic application that will: <br /> a. Allow riders to register for service. <br /> b. Display routes of the service. <br /> c. Provide real-time GPS location of vehicles. <br /> (Note: Rider registration is not required to utilize microtransit service.) <br /> 5. Regardless of level of technology an individual possesses, the Contractor will also provide each of the <br /> following methods of ridership from the circulating shuttle route(s): <br /> a. Through telephone call; <br /> b. Waiting at designated stop;and <br /> c. Hailing from signalized intersection. <br /> 6. Contractor will be able to operate agreed upon dynamic route(s) seven(7) days a week from 7:00 A.M. <br /> to 3:00 A.M. continuous operation daily. Contractor will have the ability to adapt the schedule with a one <br /> (1)week advance written notification to accommodate key community events or at the request of the City. <br /> 7. Contractor will provide a minimum fleet of two (2) vehicles in continual operation with the ability to <br /> increase up to six(6)vehicles in operation based upon demand. Contractor will have appropriate spare <br /> ratio of vehicles onsite. At least one (1) vehicle will be available to accommodate paratransit requests <br /> during all operating hours. Contractor will provide dedicated charging for vehicles during the program. <br /> All vehicles under this contract are required to meet all requirements to legally and safely operate on City <br /> of San Marcos streets and provide safe transportation. All weather vehicles are required. Tinted windows <br /> are not permitted. <br /> 8. Contractor will accommodate service animals as identified by ADA, Title II and IIl, which states that a <br /> service animal is a dog or miniature horse that is individually trained to do work or perform tasks for the <br /> benefit of an individual with a disability. This does not include comfort and emotional support animals. <br /> Vehicles will include posted signage stating only service animals are permitted. <br /> 9. Contractor will provide a health and safety response plan and policy updates in relation to the current <br /> health risks of COVID-19 and other public health concerns. Mitigation efforts will include employee <br /> personal protective equipment ("PPE"), sanitation and safety supplies including, but not limited to, <br /> disinfectant cleaner, hand sanitizer, and face masks. Signage for riders will be displayed detailing <br /> cleaning schedule and recommendations for safe ridership. Contractor will provide interior and exterior <br /> vehicle cleaning pre-and post-shift daily. <br /> 10. Drivers and customer services representatives will demonstrate knowledge of Downtown San Marcos. <br /> The Contractor will advertise locally for positions through Texas State University Career Services, local <br /> media, and other means at the City's request. <br /> 11. Operators will provide consistent marketing and educational messages as desired by and at the discretion <br /> of the City of San Marcos. Marketing rights and advertising revenue will be retained by the City. <br /> Rev 06.13.2022 Page 8 of 12 <br />
