ii. Reconciliation of the grade difference between parcels will be <br /> coordinated by staff. <br /> 2. Chapter 3, Article 7, New Streets, shall be modified to include the cross <br /> sections in Exhibit D. <br /> 3. San Marcos Development Code Chapter 6, Article 1, Division 2, Section <br /> 6.1.2.2(A) and Section 6.1.2.2(B) (Environmental Regulations; Site <br /> Planning; Cut and Fill Standards) is amended to increase the maximum <br /> cut and maximum fill on a tract of land from four feet in depth to twelve <br /> feet in depth in order to orient buildings with appropriate setbacks and <br /> configurations towards residential neighbors. <br /> C. In addition to the standards within the SMDC, as modified by this agreement, the <br /> following special standards, not normally applicable in the City or ETJ shall apply: <br /> 1. All buildings shall be designed and certified to Leadership in Energy and <br /> Environmental Design ("LEED") Certified standards. <br /> 2. Roofs shall be designed to facilitate the future installation of solar panels. <br /> 3. A minimum of two (2) Electric Vehicle ("EV") charging stations shall be <br /> provided at each building. <br /> 4. Grass lined stormwater infrastructure shall be provided. <br /> 5. Setback standards shall be increased for property lines adjacent to <br /> residentially used properties within the ETJ. <br /> i. A minimum 100' building setback shall apply instead of the zoning <br /> requirement of 20'. <br /> 6. Where an industrial property line abuts a single-family property line, <br /> screening shall be provided in the form of a 4' to 6' tall undulating berm. <br /> i. Where a right of way or public access easement for an internal drive <br /> is abutting the single-family property line, a berm shall not be <br /> required. <br /> 7. Waste-Related Service uses currently permitted in the Light Industrial "LI" <br /> district shall be prohibited. <br /> 1.05 Application Procedures <br /> A. Development of the Property shall be governed by the following: <br /> 1. All procedures outlined in the SMDC and City of San Marcos Code of <br /> Ordinances, as they exist on the effective date of this Agreement, shall <br /> apply. <br /> 2. Plat Approval: The Parties agree that the approved land uses in each final <br /> plat of portions of the Property shall be consistent with the Conceptual Land <br /> Use Plan and Exhibit "B" attached hereto. <br /> 3. Parkland Dedication: Parkland dedication requirements do not apply to <br /> industrial development <br /> 4. Permits. All permits applicable to properties within the City Limits shall apply <br /> to this Property regardless of ETJ status. <br /> 1.06 Utilities <br /> A. An Out of City Utility Connection / Extension application will not be required for the <br /> development of this Property provided that the terms of this Agreement are met. <br /> 3 <br />
