B. The Owner shall be responsible for the payment of all costs associated with the <br /> extension and improvements of the infrastructure required to properly serve <br /> development of the Property. <br /> C. Provisions for providing Water Service to the Property. <br /> 1. Maxwell Special Utility District is the water service provider and has the <br /> necessary CCN to serve the Property. <br /> D. Provisions for providing Wastewater Service to the Property <br /> 1. The Owner agrees to request to opt into the City's Wastewater CCN within <br /> 60 days of the Effective Date of this Agreement. The request shall be in <br /> writing and a copy of the request shall be provided to City of San Marcos. <br /> 2. The process for opting into the City of San Marcos CCN must be complete <br /> prior to issuance of a building permit. <br /> E. Provisions for providing Electric Service to the Property <br /> 1. Pedernales Electric is the electric service provider and has the necessary <br /> CCN to serve the Property. <br /> 2. The Property is not currently within the City of San Marcos Electric Utility <br /> Service Area; however, the San Marcos Electric Utility Roadway Lighting <br /> Standards will apply. <br /> 1.07 Public Facilities Schedule and Financing <br /> A. Public facilities and services will be provided as ordinarily allowed for <br /> development subject to the SMDC. The Owner intends to privately finance such <br /> public facilities. <br /> 1.08 Annexation <br /> A. Upon approval of this Agreement, the Owner agrees to the full purpose annexation <br /> of the Property. Upon submission of a final subdivision plat application, the Owner <br /> shall submit complete applications for annexation and zoning. The City hereby <br /> guarantees the continuing ETJ status of the remainder of the Property not subject <br /> to a final plat until such time that a final plat application is received for all or any <br /> portion of such remainder of the Property. <br /> B. The Parties acknowledge and agree, pursuant to Sections 43.0672 and <br /> 212.172(b)(7) and (8) of the Texas Local Government Code, the terms of any <br /> annexation shall provide that such annexation is conditioned on and subject to <br /> zoning of the Property being consistent in all respects with the terms of this <br /> Agreement. <br /> 4 <br />
