DESCRIPTION OF 0.38 ACRES, MORE OR LESS, IN THE T.H.W. FORSITH SURVEY, ABSTRACT NUMBER 173, HAYS COUNTY, TEXAS AND BEING A PORTION OF A 50 FOOT WIDE ROADWAY EASEMENT KNOWN AS TRIPLE CROWN RUN AND RECORDED IN VOLUME 344, PAGE 18 OF THE HAYS COUNTY DEED RECORDS, AND A PORTION OF THAT TRACT DESCRIBED AS 0.94 ACRES IN A DEED FROM JOE B. MILLICAN ET UX TO L.O. BACKUS DATED MARCH 10, 1978 AND RECORDED IN VOLUME 307 PAGE 319 OF THE HAYS COUNTY DEED RECORDS AND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: BEGINNING at a 1/2" iron rod found with a plastic cap stamped "B&A RPLS 2633" for the west corner of this tract, the Backus tract and Triple Crown Run and for the north corner of a that tract described as 248.711 acres in a deed from the San Marcos River Foundation, Inc. to the City of San Marcos dated August 13, 2018 and recorded in Hays County Instrument Number 18028923 in the Hays County Official Public Records, and being in the southeast line of that tact described as 4.02 acres in a deed from Hanno Guenther et ux to Michael A. Guzaldo dated October 22, 1979 and recorded in Volume 333, Page 361 of the Hays County Official Public Records and being in the southeast line of the Tract 20 of the unrecorded subdivision of County Estates, Section Four; THE, leaving the City of San Marcos tact and the PLACE OF BEGINNING as shown on that plat numbered 28144-22-3-b dated December 20, 2022, as prepared for the City of San Marcos by Byrn & Associates, Inc. of San Marcos, Texas with the common northwest line of the Backus tract and Triple Crown Run and southeast line of the Guzaldo tract and Tract 20, County Estates, Section Four and its extension, N 38° 42' 06" E 49.94 feet to a 1/2" iron rod set for the common north corner of this tract, the Backus tract and Triple Crown Run and west corner of that tract described as 2.63 acres in a deed from Robert E. Patton et ux to Patton Family Revocable Trust dated July 13, 2013 and recorded in Volume 4721, Page 577 of the Hays County Official Public Records and Tract 9 of the unrecorded subdivision of Backus Estates, pass at 2.22 feet the common west corner of the Guzaldo tract and Tract 20, County Estates, Section Four and the south corner of Mustang Lane; THENCE leaving Mustang Lane and County Estates, Section Four with the common northeast line of the Backus tract and Triple Crown Run and the southwest line of the Patton Family Revocable Trust tract and Tract 9 of Backus Estates the following two courses: 1. S 570 05' 10" E 211.35 feet to a 1/2" iron rod rod set for the common south corner of the Patton Family Revocable Trust and Tract 9 of Backus Estates and a north angle point of the Backus tract and Triple Crown Run; THENCE leaving the Patton Family Revocable Trust tract and Tract 9 of Backus Estate and crossing the Backus tract and Triple Crown Run, S 57° 05' 10" E 81.18 feet to a 1/2" iron rod set in the common southeast line of the Backus tract and Triple Crown Run and the northwest line of that tract described as 3.07 acres in a deed from Bill Richards et ux to B.J.
