INTERLOCAL COOPERATION AGREEMENT <br /> BY AND BETWEEN <br /> THE CITY OF SAN MARCOS AND TEXAS STATE UNIVERSITY <br /> RE: PROCESS FOR CITY CONSIDERATION OF TEXAS STATE <br /> UNIVERSITY'S REQUESTS FOR FTA PASS THROUGH <br /> FUNDING OF PROPOSED TRANSIT PROJECTS <br /> This Interlocal Cooperation Agreement (the "Agreement") is made and effective as of <br /> , 2022 (the "Effective Date") by and between the City of San Marcos, San <br /> Marcos, Texas, with an address of 630 East Hopkins Street (the "City"), and Texas State <br /> University, with an address of 601 University Drive, San Marcos, Texas 78666 ("Texas State"). <br /> The City and Texas State are each referred to hereinafter as a "Party" and collectively as the <br /> "Parties." <br /> ARTICLE I <br /> RECITALS <br /> 1.01. In 2019,the City and Texas State completed the Coordinated Transit Study,which <br /> was adopted in 2020 as the San Marcos Transit Plan (the "Plan"). The Plan <br /> identified key opportunities for a coordinated transit system which included: <br /> qualifying for additional Federal funding, expanding transit access for the entire <br /> community, improving multimodal connectivity, and responding to continued <br /> population and enrollment growth. <br /> 1.02. The Plan recommends the development of an interlocal agreement to initiate <br /> implementation of a coordinated San Marcos Transit and Bobcat Shuttle Systems, <br /> with the development a single brand for both systems and entering into a long-term <br /> contract with a third party to provide transit service for both the City and Texas <br /> State. <br /> 1.03. City acts as the Direct Recipient for the Federal Transit Administration ("FTA") <br />
