with regard to certain Urbanized Area Formula Grant Funds ("Formula Grant Funds") and Small <br /> Transit Intensive Cities funds ("STIC Funds) for the San Marcos Urbanized Area, and such other <br /> funding sources as may be provided by the FTA's Grants for Buses and Bus Facilities Program <br /> codified at 49 U.S.C. Section 5339 and Emergency Relief funds. All of these federal sources of <br /> money shall be referred to collectively as"Federal Funding"or"Federal Funds"in this Agreement. <br /> Sub-award funding agreements shall be made by separate agreement upon the mutual agreement <br /> of the Parties for all projects following those funded by the Funding Allocation(Exhibit B). <br /> 1.04. The FTA allows City to make Sub-award funding agreements of the Federal <br /> Funding it receives to selected sub-recipients provided that the sub-recipient receiving a sub-award <br /> agrees to and complies with responsibilities as a pass-through recipient that are required to be <br /> performed by City as the Direct Recipient. <br /> 1.05. City will use a federally approved subrecipient funding agreement ("Subrecipient <br /> Funding Agreement") for award of Federal Funds to ensure grant compliance with and maximize <br /> future funding opportunities. <br /> 1.06. Texas State seeks funding as a sub-recipient for the preliminary transportation <br /> project proposals as described on Exhibit A, a copy of which is attached hereto and incorporated <br /> herein for all purposes. <br /> 1.07. Based on information provided by Texas State's and City's initial assessment of <br /> the Projects, the Projects qualify for financial assistance from the STIC Funds provided Texas <br /> State meets the requirements to be a sub-recipient of such funds. <br /> 1.08. Texas State has committed to undertake the necessary measures, and City believes <br /> Texas State has the appropriate resources, to become an eligible sub-recipient of Formula Grant <br /> Funds. <br />
