If to the City: If to Texas State: <br /> City of San Marcos V.P. for Finance and Support Services <br /> 630 East Hopkins Street Texas State University <br /> San Marcos, Texas 78666 601 University Drive <br /> Attn: City Manager San Marcos, Texas 78666 <br /> citynianagerinfo@saniiiarcosix.goi) _yl.)fss@wtate.edit <br /> Either Party may change the information for notice by providing written notice of such change to <br /> the other Party. <br /> ARTICLE VI <br /> PROJECTS SUBJECT TO FEDERAL FUNDING AND COUNCIL APPROVAL <br /> The City's commitment herein to place a Subrecipient Funding Agreement for a.Project on <br /> an agenda for consideration of approval by the City Council is subject to the continuing availability <br /> of Federal Funds that would be applied toward the cost of the Project. If such Federal Funds are <br /> no longer available for award to a Project, the obligations of the Parties will be suspended until <br /> such time as other such Federal Funds are made available to the City. Notwithstanding any other <br /> provisions in this Agreement, it is understood that the City Council shall have no obligation to <br /> finally approve any Subrecipient Funding Agreement for a Project even if recommended by City <br /> staff, such approval being a discretionary act of the City Council. <br /> ARTICLE VII <br /> GENERAL <br /> 7.01. Entire Agreement. This Agreement constitutes the entire agreement between the <br /> Pat-ties, and there are no representations, warranties, agreements or commitments between the <br /> Parties hereto except as set forth herein. <br /> 7.02. No Waiver. No delay or failure by either Patty hereto to exercise any right,power <br /> or remedy under this Agreement, and no partial or single exercise of that right, power or remedy <br /> shall constitute a waiver of that or any other right, power or remedy unless otherwise expressly <br />
