<br /> TRANSFER,ASSIGNMENT,GRANT,
<br /> SALE AND CONVEYANCE OF EASEMENT RIGHTS
<br /> This Second Correction Transfer, Assignment, Grant, Sale and Conveyance of Easement
<br /> Rights (this"Second Correction") is made to be effective as of October 30, 1986 (the"Effective
<br /> Date")and is entered into by and among THE CITY OF SAN MARCOS,a municipal corporation,
<br /> herein referred to as"Grantee,"and the LOWER COLORADO RIVER AUTHORITY,a political
<br /> subdivision of the State of Texas, herein referred to as"Grantor."
<br /> WHEREAS, reference is made to that certain Transfer, Assignment, Grant, Sale and
<br /> Conveyance of Easement Rights from the Lower Colorado River Authority to The City of San
<br /> Marcos, dated effective October 30, 1986, and recorded in Volume 634, Page 818 of the Real
<br /> Property Records of Hays County,Texas(the"Original Assignment");
<br /> WHEREAS,reference is also made to that certain Correction Transfer,Assignment,Grant,
<br /> Sale and Conveyance of Easement Rights from the Lower Colorado River Authority to The City
<br /> of San Marcos, dated effective October 30, 1986, and recorded in Volume 1324, Page 857 of the
<br /> Real Property Records of Hays County,Texas(the"First Correction");
<br /> WHEREAS, it has been determined that the Original Assignment mistakenly did not
<br /> transfer, assign, grant, sell and convey to Grantee the following easement (the "Subject
<br /> Easement"):
<br /> That certain Easement from T. A. Buckner and Sons to Lower Colorado River
<br /> Authority dated February 20, 1984, recorded February 22, 1984 in Volume 420,
<br /> Page 783 of the Real Property Records of Hays County, Texas (the "Subject
<br /> Easement")
<br /> WHEREAS,this Second Correction is made by Grantor,and accepted by Grantee to amend
<br /> the Original Assignment and the First Correction to add the Subject Easement to Exhibit "A"
<br /> attached thereto, and in all other respects this Second Correction confirms the Original
<br /> Assignment, as the same has been corrected and amended by the First Correction and as further
<br /> corrected and amended herein.
