for the useful life of any pavement constructed, reconstructed, or repaired with Federal <br /> financial assistance at the airport. As a minimum, the program must conform to the <br /> provisions in Attachment D "Pavement Maintenance Management Program", attached <br /> and made a part of this agreement. <br /> 11. the Sponsor agree that because State highway specifications will be used for airfield <br /> pavement construction instead of FAA standard specifications, it will not seek AIP grant <br /> funds or supplemental appropriation funds for the rehabilitation or reconstruction of <br /> airfield pavement included in this Grant Agreement for a period of 10 years after <br /> construction is completed unless the FAA determines that the rehabilitation or <br /> reconstruction is required for safety reasons,per 49 U.S.0 § 47015(c) or 47114(d)(5). <br /> 12. Fencing- if applicable, the Sponsor understand that the fence is being installed to <br /> prevent wildlife from entering the airfield. The Sponsor agrees to maintain the integrity <br /> of the fence for its useful life, but no less than 20 years from the date this Grant was <br /> issued. The Sponsor understand that maintenance of the fence includes repair of damage <br /> to the fence or gates due to any purpose. <br /> Part IV-Nomination of the Agent <br /> 1. The Sponsor designates the State as the party to apply for, receive and disburse all funds <br /> used, or to be used, in payment of the costs of the project, or in reimbursement to either <br /> of the parties for costs incurred. <br /> 2. The State agrees to assume the responsibility to assure that all aspects of the grant and <br /> project are done in compliance with all applicable state and federal requirements <br /> including any statutes,rules,regulations, assurances,procedures, or any other directives, <br /> except as otherwise specifically provided. <br /> 3. The State shall, for all purposes in connection with the project identified above, be the <br /> Agent of the Sponsor. The Sponsor grants the State a power of attorney to act as its agent <br /> to perform the following services: <br /> Receiving Disbursing Agent: <br /> a. apply for, accept, receive, and deposit with the State Treasury any and all project <br /> funds granted, allowed, and paid or made available by the State and/or the United <br /> States under Title 49 U.S.C. and congressional appropriation made pursuant <br /> thereto, and the Sponsor; <br /> b. receive, review, approve and process Sponsor's reimbursement requests for <br /> approved project costs; and <br /> C. pay to the Sponsor, from granted funds, the portion of any approved reasonable <br /> and eligible project costs incurred by the Sponsor that are in excess of the <br /> Sponsor's share. <br /> Page 11 of 44 V.9-1-23 <br />
