in accordance with applicable ordinances on a schedule to run concurrently with the schedule for <br />annexation, provided that the sequence for final adoption of an annexation ordinance will precede <br />the adoption of any final zoning ordinance. If such zoning requests are not approved, Developers <br />may apply for such comprehensive plan and zoning map amendments as Developers deem <br />appropriate for any proposed developments in accordance with then applicable ordinances and <br />procedures of the City or develop the portions of the ETJ Land in accordance with the allowed <br />uses specified in Exhibit "G." <br />a. Nonconforming Status. Upon expiration of the Term, any existing active <br />permitted and conditional land allowed under Exhibit "G" and related improvements on <br />any portion of the ETJ Land, if inconsistent with the zoning for any such portion, will be <br />considered to be legally nonconforming uses and structures subject to applicable <br />ordinances regarding changes to legally nonconforming uses and structures. For example, <br />if a structure is destroyed by fire, the newly constructed replacement would have to comply <br />with then current City ordinances. If, however, a lot is not developed with a permitted or <br />conditional land use before the expiration of the Term, then later development of the lot <br />must conform to then applicable zoning ordinances. <br />Section 6.04. Review Process. The City acknowledges that efficient and expedited City <br />reviews are necessary for the effective implementation of the Project. Therefore, the City agrees <br />to expedite the review and approval of all development permits required for development of the <br />Project Site for Company's Business. It is understood and agreed by Developers, however, that <br />such expedited review and approval is limited to matters over which City staff operates under <br />internal processes and schedules not governed by mandatory procedures and time periods under <br />City ordinances or state law.
