As part of this process, the City will also facilitate <br />concurrent review of applications for permits for development of the Project Site, specifically to <br />include applications for watershed protection plans, public improvement construction plans, <br />preliminary and final plats and site plans. <br />Section 6.05 Building and Development Code Compliance. Subject to Section 6.07 <br />below, Developers acknowledge and agree that all phases of construction on the Land, occurring <br />both before and after annexation, shall be subject to compliance with the City's utility, building <br />and development ordinances including Chapters 14, 38, 39, 86 and Subpart B -Land Development <br />Code ("LDC") of the City's Code of Ordinances. Such compliance shall include consent to <br />building inspections by the City, adherence to exterior building materials and articulation <br />standards, payment of any application fees, impact fees, permit fees and inspection fees. <br />Notwithstanding the foregoing, with regard to the applicability of the LDC to site development <br />(not building design and construction) on the Project Site, only those provisions of the LDC <br />normally applicable to site development in the ETJ shall apply to the Project Site. <br />Section 6.06 Water and Wastewater Service. Based on Developers' consent to <br />annexation under the terms of this Agreement, individualized out of city utility requests are not <br />required to be filed. Upon annexation, the City agrees to make available retail water and <br />wastewater services to and within the Land as portions are platted on the same basis that such <br />services are available to other residents of the City and subject to compliance with the City's Code <br />of Ordinances. Subject to Section 6.08 below, Developers agree to provide and extend, at <br />Developers' sole expense all infrastructure necessary to serve the development of the Land and <br />roughly proportional to the impact of such development. <br />IN <br />
