)o � <br /> MEMORANDUM OF UNDERSTANDING/INTERLOCAL AGREEMENT("MOU/ILA") <br /> AMONG PARTICIPATING LOCAL GOVERNMENTS FOR SHARING OF IPAWS ALERTING <br /> AUTHORITY PERMISSIONS <br /> I. <br /> PARTIES <br /> This MOU/ILA is entered by and among the undersigned participating local governments of the State of <br /> Texas ("Participating Local Government"), acting by and through their respective governing bodies and <br /> Hays County, Texas ("Hays County"), pursuant to and under authority of the Interlocal Cooperation Act, <br /> Chapter 791 of the Texas Government Code to share Integrated Public Alert and Warning Systems <br /> ("IPAWS") Alerting Authority access. The undersigned Participating Local Governments adopting this <br /> MOU/ILA upon a formal order of their respective governing bodies as provided for herein may be referred <br /> to in this MOUALA individually as"Party"and collectively as"Parties." <br /> H. <br /> RECITALS <br /> WHEREAS the Participating Local Government operates an emergency response organization(ERO)that <br /> uses a Regional Notification System to communicate with the public for the purpose of warning or alerting <br /> citizens regarding information in emergency situations where property or human life is in jeopardy that can <br /> send IPAWS messages. <br /> WHEREAS Hays County has been granted IPAWS Alerting Authority permissions by the Federal <br /> Emergency Management Agency(FEMA)and the State of Texas. <br /> WHEREAS the Hays County IPAWS Alerting Authority agreement is active and current. <br /> WHEREAS this MOU/ILA is intended by the Parties to follow the Memorandum of Agreement between <br /> Hays County and the Federal Emergency Management Agency Integrated Public Alert and Warning System <br /> (IPAWS)Program Management Office regarding the use of. Hays County, Texas Interoperable System(s) <br /> and IPAWS OPEN Platform for Emergency Networks(IPAWS-Open). <br /> WHEREAS Hays County, Texas in conjunction with the Office of Emergency Management (or named <br /> agency) operate IPAWS to assist Participating Local Governments with the activation of IPAWS. <br /> WHEREAS Hays County and the Office of Emergency Services desire to provide access to the <br /> Participating Local Government at no cost to effectuate the efficient publishing of IPAWS messages. <br /> WHEREAS Participating Local Govermnents and their respective authorized users desire to publish <br /> IPAWS messages. <br /> WHEREAS "Data" shall mean the language of the message and the details regarding its distribution <br /> (metadata). <br /> WHEREAS, this MOU/ILA, including all addenda, amendments, exhibits and attachments hereto, sets <br /> forth the policies,practices, and responsibilities of the Participating Local Governments. <br /> IPAWS MOU <br /> 1 <br />
