WHEREAS the Participating Local Govermnents recognize and agree to adhere to Hays County and <br /> FEMA's policies regarding use of IPAWS; and <br /> WHEREAS, the Participating Local Governments, acting by and through their respective governing <br /> bodies, individually and collectively, do hereby adopt and find the foregoing premises as findings of said <br /> governing bodies. <br /> NOW,THEREFORE,in consideration of the promises, inducements,covenants,agreements, conditions, <br /> and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, <br /> the Participating Local Governments approving this MOU/ILA agree as follows: <br /> III. <br /> PARTICIPATION BY ADDITIONAL PARTICIPATING LOCAL GOVERNMENT <br /> Any local government located within Hays,Texas may participate in this MOU/ILA with the administrative <br /> approval of Hays County and the County Emergency Manager. Each Participating Local Government will <br /> be required to approve and agree to the terms and conditions of this MOU/ILA. The participation of <br /> additional Participating Local Governments shall not require the approval of other Participating Local <br /> Governments. <br /> IV. <br /> INCORPORATED DOCUMENTS AND AUTHORITIES <br /> The following documents and authorities are incorporated by reference for all purposes and made a part of <br /> this MOU/ILA for all Participating Local Governments: <br /> 1. The Memorandum of Agreement between Hays County and the Federal Emergency Management <br /> Agency Integrated Public Alert and Warning System (IPAWS) Program Management Office <br /> regarding the use of. Hays County, Texas Interoperable System and IPAWS OPEN Platform for <br /> Emergency Networks(IPAWS-Open) <br /> 2. CAPCOG RNS Policies and Procedures <br /> 3. All applicable Texas and federal law. <br /> 4. All applicable Texas Department of Public Safety policies <br /> 5. All applicable Texas Division of Emergency Management policies. <br /> V. <br /> TERM AND WITHDRAWAL <br /> A. Unless otherwise stated,this MOU/ILA shall remain in effect from the time of its authorized <br /> signing until a termination by a Party occurs. <br /> B. A Participating Local Government may withdraw from this MOU/ILA at any time and for any <br /> reason by giving ninety(90) days prior written notice to the County Emergency Manager. Hays <br /> County and the County Emergency Manager agree to provide the Participating Local Government <br /> with access to its IPAWS Alerting Authority at no charge during the term of this MOU/ILA.
