Mayor Morris introduced for consideration an Executive Session pursuant to Article 6252-17, Sections 2(e), (f) and (g), V.A.C.S., to discuss pending litigation (GBRA vs. City of Lytle, Et AI; Southern Climate Co. vs. J. K. Richardson Co., Et AI; Helen Rodriguez vs. City of San Marcos), contemplated litigation and matters where the duty of the City Attorney to the City pursuant to the Code of Professional Responsibility of the State Bar of Texas clearly conflicts with Article 6252-17; purchase of real property, lease of real property, duties of a public officer, respectively. Mr. Moore moved the Council adjourn into Executive Session at 8:44 p.m. and Mr. Plummer seconded the motion, which passed unanimously. Mr. Hernandez moved to reconvene at 10:21 p.m. and Mr. Moore seconded the motion, which passed unanimously. Mayor Morris introduced for discussion Item 10.B. which had been delayed to follow Executive Session, a discussion regarding a proposed policy for direct expenditures from the Council Tourist Account and direction to Staff. Mayor Morris stated Mr. Guerra and Ms. Kissler, in cooperation with Messrs. Gilley and Taylor, will bring a policy to the Council for consideration in the near future.
