<br />89 <br /> <br /> <br /> <br />Regular Meeting February 25, 1991 Page 2 <br /> <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY HISTORICAL ZONING ORDINANCE WITH <br />REGARD TO MEMBERSHIP QUALIFICATIONS FOR THE HISTORIC <br />PRESERVATION COMMISSION; PROVIDING FOR SEVERABILITY; REPEALING <br />ALL CONFLICTING ORDINANCES; PROVIDING FOR PUBLICATION; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for approval of the Ordinance on first reading and <br />Mr. Moore seconded the motion. Mayor Morris moved to amend the <br />Ordinance as follows: Amend SECTION 1. (d) to read, "One member <br />shall be a property owner or resident from the San Antonio Street <br />Historic District," add a new SECTION 2. to read, "That subsections <br />(e) and (f) of section 3 of the Historical Zoning Ordinance of <br />the City, codified in Appendix G of the City of San Marcos Code of <br />Ordinances, are hereby added as follows: (e) One member shall be a <br />property owner or resident from the Belvin Street Historic District. <br />(f) One member shall be a property owner or business owner within <br />the Downtown Historic District." The remaining SECTIONS shall be <br />renumbered 3.,4. and 5. Ms. Kissler seconded the motion, which <br />passed unanimously. The Council then voted unanimously for approval <br />of the Ordinance on first reading. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 3-40 OF CHAPTER 3, ANIMALS AND FOWL OF <br />THE SAN MARCOS CODE OF ORDINANCES, TO INCLUDE "HANDLER" IN <br />SUBSECTIONS (B) AND (C); PROVIDING FOR SEVERABILITY; REPEALING <br />ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR <br />PUBLICATION; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for approval of the Ordinance on first reading and <br />Mr. Hernandez seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration adoption of a Resolution, <br />the caption which was not read into the record, but which reads as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING AN AMENDMENT TO THE WATER FACILITIES AND <br />ROADWAY IMPROVEMENTS CONTRACT BETWEEN THE CITY AND THE PROPERTY <br />OWNERS WITHIN THE ESTATES OF SAN MARCOS SUBDIVISION; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT ON BEHALF <br />OF THE CITY; AUTHORIZING THE CITY MANAGER TO EXECUTE RELEASES <br />TO INDIVIDUAL PROPERTY OWNERS; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Taylor advised the Council Staff needs to verify the <br />calculations made by the Subdivision's engineer before entering into <br />this Agreement. Ms. Kissler moved to table adoption of the <br />Resolution and Mr. Moore seconded the motion, which passed <br />unanimously. <br /> <br />Mayor Morris introduced for consideration approval of minutes of the <br />Regular Meeting held February 11, 1991, approval of an Ordinance on <br />second reading, adoption of two Ordinances on third and final <br />reading, adoption of three Resolutions, authorization to bid for <br />Police Special Purpose utility Vehicle, and approval to purchase <br />four vehicles for the San Marcos Electric Utility through the State <br />Purchasing and General Services commission in the amount of <br />$48,383.00 by consensus. Mr. Hernandez moved to approve the minutes <br />of the Regular Meeting held February 11, 1991, to approve the <br />Ordinance on second reading, to adopt the two Ordinances on third <br />and final reading, to adopt the three Resolutions, to authorize <br />bidding for the Police Special Purpose utility Vehicle and to <br />approve the purchase of four vehicles for the San Marcos Electric <br />Utility through the State Purchasing and General Services commission <br />in the amount of $48,383.00 on consensus, and Mr. Moore seconded the <br />motion, which passed unanimously. <br />
