<br />8 <br /> <br /> <br /> <br />Regular Meeting April 8, 1991 Page 6 <br /> <br /> <br />Mayor Morris introduced a discussion regarding tape recordings of <br />Council Meetings. Mr. Taylor advised the Council if tapes are made <br />of Executive Sessions, they need to be kept locked up unless a <br />District Court requests the release of same. The only time a <br />District Court would request release of a tape from an Executive <br />Session is if there was an alleged violation of the Open Meetings <br />Laws. It was consensus of Council to continue the use of Certified <br />Agendas. <br /> <br />Mayor Morris introduced a discussion regarding the City's interest <br />in the Texas Municipal League forming a statewide Telephone <br />Franchise Steering Committee and direction to Staff. It was <br />consensus of Council to support having the Committee but not to <br />financially support the Committee, and for a Resolution to be <br />prepared showing the City's support. <br /> <br />Mayor Morris introduced a Status Report on pending legislation <br />affecting the Edwards Aquifer. The Council was provided with a <br />handout regarding the legislation issues, and was advised it will <br />probably be considered the end of April. The Council was advised <br />the City of San Marcos would be involved in any litigation that <br />might be filed. <br /> <br />Mayor Morris introduced the City Manager's Report. (1) Mr. Gilley <br />announced the Employee of the Month is Syd Newman. (2) The Council <br />decided to have Budget Workshops on April 18 and April 19. <br /> <br />Mayor Morris introduced the City Attorney's Report. Mr. Taylor had <br />no report at this meeting. <br /> <br />Mayor Morris introduced the City Council's Report. (1) Mayor <br />Morris advised she had testified beDore the House Redistricting <br />Committee and advised the Committee we are happy where we are. (2) <br />Mayor Morris advised she had read an article where the City of <br />Newton, Maine had a pilot program using compressed natural gas as an <br />alternative fuel. Mr. Gilley stated the source for natural gas is <br />very limited, but there would probably be a supplier at some future <br />time. He stated another alternative fuel could be propane/butane. <br />Mr. Boeker advised the Council he is already looking at alternative <br />fuels for the future. (3) Mr. Hart advised he and Dee Hart have an <br />8 pound 14 ounce new baby girl named Chelsey Grace and moth~r and <br />baby are doing fine. (4) Ms. Kissler advised the Council Fred <br />Guerra's picture is in the latest NLC publication as Treasurer for <br />the HELO organization. (5) Mr. Moore advised the Council that he <br />and Melissa Millecam are prepared to present testimony to support <br />the Texas Protective River Act. <br /> <br />Mayor Morris introduced an Executive Session pursuant to Article <br />6252-17, Sections 2(e) and (g), V.A.C.S., to discuss pending <br />litigation (GBRA vs. City of Lytle, Et AI; Olivo vs. Cannon, Et AI), <br />contemplated litigation, and matters where the duty of the <br />City Attorney to the City pursuant to the Code of Professional <br />Responsibility of the State Bar of Texas clearly conflicts with <br />Article 6252-17; and evaluation of a public employee (City Attorney) <br />and duties of a public officer, respectively. Mr. Guerra moved to <br />adjourn into Executive Session at 11:18 p.m. and Mr. Hart seconded <br />the motion, which passed unanimously. <br /> <br />Mr. Hernandez moved to reconvene at 12:35 a.m. and Mr. Moore <br />seconded the motion, which passed unanimously. <br /> <br />The meeting adjourned at 12:36 a.m. on motion made by Ms. Kissler <br />and seconded by Mr. Moore. ~ I^ I ~ <br /> <br />.
