<br />35 <br /> <br /> <br /> <br />Regular Meeting April 22, 1991 Page 3 <br /> <br /> <br />the years of service to the community and introduced Russell Hughes <br />of TCI, who was present to answer questions of the Council. Mr. <br />Guerra asked Mr. Taylor what legal basis would the City have to deny <br />the transfer, and Mr. Taylor stated lack of financial <br />responsibility. Mr. Hernandez asked Mr. Hughes if they would have <br />the capacity to expand service, expressed concern of the citizens <br />what the rate structure would be and asked for information regarding <br />TCI's hiring practice of minorities. Mr. Hughes stated he would <br />bring percentages of minority hiring and an audit by FCC, that the <br />rate structure would be similar to New Braunfels', and that they <br />reviewed programming annually. Mayor Morris asked if they were able <br />to provide coverage of community events, and was advised they did <br />not have ability to provide that at this time. Ms. Kissler asked if <br />the Council Meetings would soon be televised, and the Mayor advised <br />we would have to request and receive RFPs for that. Mr. Gilley <br />advised staff would be going on-site to observe some televised <br />Council meetings. The Council requested this Ordinance not be <br />placed on consensus during readings. Mr. Taylor advised TCI and he <br />are negotiating some terms they wish to have in the franchise. He <br />stated the franchise now requires rebuild in August, 1993, and they <br />are requesting this be changed to 1995, which would be a substantive <br />change. The Council voted unanimously for approval of the Ordinance <br />on first reading. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTIONS 29-109 AND 29-110 OF THE SAN MARCOS <br />CODE OF ORDINANCES BY THE ADDING AND DELETING LOCATIONS FOR <br />TRAFFIC CONTROL DEVICES IN THE WESTOVER ADDITION OF SAN MARCOS; <br />PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING <br />ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Guerra moved for approval of the Ordinance on first reading and <br />Mr. Plummer seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTIONS 29-111 AND 29-150 OF THE SAN MARCOS <br />CODE OF ORDINANCES BY ADDING A NO PARKING TOW-AWAY ZONE ON <br />HOPKINS STREET; PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR <br />PUBLICATION AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Guerra moved for approval of the Ordinance on first reading and <br />Ms. Kissler seconded the motion. On roll call the following vote <br />was recorded: <br /> <br />AYE: Hernandez, Morris, Kissler, Plummer. <br /> <br />NAY: Moore, Hart, Guerra. <br /> <br />ABSTAIN: None. <br /> <br />The Ordinance passed on first reading. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ESTABLISHING FEES IN COMPLIANCE WITH THE PROVISIONS OF <br />THE SAN MARCOS CODE OF ORDINANCES, CHAPTER NINE, ELECTRICAL <br />CODE; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING <br />ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for approval of the Ordinance on second reading and <br />Mr. Plummer seconded the motion.
