Mr. Guerra asked Mr. Taylor what legal basis would the City have to deny the transfer, and Mr. Taylor stated lack of financial responsibility. Mr. Hernandez asked Mr. Hughes if they would have the capacity to expand service, expressed concern of the citizens what the rate structure would be and asked for information regarding TCI's hiring practice of minorities. Mr. Hughes stated he would bring percentages of minority hiring and an audit by FCC, that the rate structure would be similar to New Braunfels', and that they reviewed programming annually. Mayor Morris asked if they were able to provide coverage of community events, and was advised they did not have ability to provide that at this time. Ms. Kissler asked if the Council Meetings would soon be televised, and the Mayor advised we would have to request and receive RFPs for that. Mr. Gilley advised staff would be going on-site to observe some televised Council meetings. The Council requested this Ordinance not be placed on consensus during readings. Mr. Taylor advised TCI and he are negotiating some terms they wish to have in the franchise. He stated the franchise now requires rebuild in August, 1993, and they are requesting this be changed to 1995, which would be a substantive change. The Council voted unanimously for approval of the Ordinance on first reading. Mayor Morris introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTIONS 29-109 AND 29-110 OF THE SAN MARCOS CODE OF ORDINANCES BY THE ADDING AND DELETING LOCATIONS FOR TRAFFIC CONTROL DEVICES IN THE WESTOVER ADDITION OF SAN MARCOS; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND DECLARING AN EFFECTIVE DATE. Mayor Morris introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTIONS 29-111 AND 29-150 OF THE SAN MARCOS CODE OF ORDINANCES BY ADDING A NO PARKING TOW-AWAY ZONE ON HOPKINS STREET; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND DECLARING AN EFFECTIVE DATE. Mr. Guerra moved for approval of the Ordinance on first reading and Ms. Kissler seconded the motion. On roll call the following vote was recorded: AYE: Hernandez, Morris, Kissler, Plummer. NAY: Moore, Hart, Guerra. ABSTAIN: None. The Ordinance passed on first reading.
