Termination for Convenience <br /> City may at any time and for any reason terminate Agency's services and work at City's convenience upon <br /> providing written notice to the Agency specifying the extent of termination and the effective date. Upon receipt of <br /> such notice,Agency shall,unless the notice directs otherwise, immediately discontinue the work and placing of <br /> orders for materials, facilities, and supplies in connection with the performance of this Agreement. <br /> This Agreement may also be terminated for convenience by either the City or the Agency,in whole or in part,by <br /> setting forth the reasons for such termination,the effective date, and,in the case of partial termination,the portion <br /> to be terminated. However,if in the case of a partial termination,the City determines that the remaining portion <br /> of the award wilt not accomplish the purpose for which the award was made,the City may terminate the award in <br /> its entirety. <br /> VII. ADMINISTRATIVE REQUIREMENTS <br /> A. Internal Controls <br /> The Agency must establish and maintain effective internal control over the award that provides reasonable <br /> assurance that the Agency is managing the award in compliance with funding source regulations and program <br /> procedures. <br /> B. Documentation and Record Keeping <br /> The City is governed by the Texas Public Information Act, Chapter 552 of the Texas Government Code. This <br /> Agreement and all written information generated under this Agreement may be subject to release under this Act. <br /> 1. Records to be Maintained <br /> The Agency shall maintain all records that are pertinent to the activities to be funded under this Agreement. Such <br /> records shall include but not be limited to: <br /> a. Records providing a full description of each activity undertaken, including its location and the amount of <br /> funds budgeted,obligated,and expended for the activity; <br /> b. Records required to determine the eligibility of activities; <br /> c. Records required to document the acquisition, improvement,use, or disposition of real property acquired or <br /> improved with assistance; <br /> d. Records documenting compliance with the fair housing and equal opportunity components of the program; <br /> e. Demographic data for beneficiaries of these funds as specified in section VII (B)(4)below; and, <br /> f. Financial records as required. <br /> 2. Access to Records <br /> The Agency shall permit the City and auditors to have access to the Agency's records and financial statements as <br /> necessary for the City to ensure the requirements are being met. <br /> 3. Client Data <br /> a. The Agency shall maintain client data demonstrating client eligibility for services provided. Such data shall <br /> include,but not be limited to, client name,address, income level or other basis for determining eligibility, and <br /> 224-156 Page 6 of 17 <br />
