R. G. Phillips asked about <br />amendments that do not pertain to this Ordinance. No one else <br />wished to speak, so Mayor Morris closed the public hearing. Mr. <br />Guerra moved for approval of the Ordinance on first reading and Mr. <br />Plummer seconded the motion. Mayor.Morris stated she would like to <br />see the wording in this Ordinance simplified before the next reading <br />and explanations what recreation facility and fraternal buildings <br />are. Mr. Hart asked for the rationale in engine overhauling <br />businesses and lumberyards and contractor yards in a Light <br />Industrial District designation. Mr. Moore stated they are zoned LI <br />because of street and/or traffic use. Mayor Morris stated she wants <br />some explanation at the next reading to Sec. 36(J) on Page 9 <br />regarding walls and shrubbery where a grade starts. The Council <br />voted unanimously for approval of the Ordinance on first reading. <br /> <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on third and final reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 16, MISCELLANEOUS OFFENSES AND <br />PROVISIONS, OF THE SAN MARCOS CODE OF ORDINANCES TO ADD AN <br />ARTICLE V, CLEAN AIR, INCORPORATING RESTRICTIONS ON SMOKING; <br />PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING <br />ORDINANCES; PROVIDING FOR A PENALTY; PROVIDING FOR PUBLICATION; <br />AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for adoption of the Ordinance on third and final <br />reading and Mr. Guerra seconded the motion. Mayor Morris moved to <br />amend the Ordinance in Section 16-72(a) to delete the second <br />sentence and add the following, "The designation of smoking areas in <br />places of employment shall be performed in accordance with Section <br />16-74, as well as with this Section," and Mr. Guerra seconded the <br />motion, which passed unanimously. The Council held a discussion <br />regarding signage for designated smoking and non-smoking areas. Mr. <br />Hart moved to amend the Ordinance to move the last sentence in <br />Section 16-72(d) to Section 16-73 (b) and reletter 16-73(b) to <br />16-73(c), and Mr. Moore seconded the motion, which passed <br />unanimously. Mayor Morris moved to amend Section 16-72 (d) to add <br />the following at the beginning of the Section, "Notwithstanding the <br />definition of clean air areas in Sec. 16-70(1), . . .", and Mr. <br />Moore seconded the motion, which passed unanimously. Mayor Morris <br />moved to amend the repealer clause of the Ordinance, SECTION 4, to <br />read as follows, "That all Ordinances and Resolutions or parts of <br />Ordinances or Resolutions in conflict herewith, including without <br />limitation Section 2-6 of the San Marcos Code of Ordinances, are <br />
