<br /> 7 <br />Regular Meeting August 12, 1991 Page 3 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, REVISING AND UPDATING ARTICLE III, INDUSTRIAL WASTE <br />REGULATIONS, OF CHAPTER 30, WATER AND SEWERS AND SEWAGE <br />DISPOSAL, OF THE SAN MARCOS CODE OF ORDINANCESi PROVIDING FOR <br />SEVERABILITYi REPEALING ALL CONFLICTING ORDINANCESi PROVIDING A <br />PENALTYi PROVIDING FOR PUBLICATIONi AND PROVIDING AN EFFECTIVE <br />DATE. <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak. Bill McDonald requested the city Council consider changing <br />the proposed rate of 5 cents per gallon to 3 cents per gallon. He <br />requested the Council consider amending the requirement of charging <br />for a full load when dumping to the actual amount on the truck. He <br />also requested a definition of the service boundaries. Bill Haney <br />stated this was a good Ordinance, and that it had been simplified <br />somewhat. He stated there still needs to be resolution to the issue <br />of sampling, self monitoring and testing. He stated if something is <br />found in a plant test that they have indicated they have in their <br />possession, would they then be caused to test for this in their <br />waste stream. Mr. Haney indicated he would prefer the city to <br />examine the affluent to determine what its consistency is, and would <br />prefer the city be required to sample and test to alleviate small <br />businesses from having to do so. No one else wished to speak so <br />Mayor Morris closed the public hearing. Mr. Guerra moved for <br />approval of the Ordinance on first reading and Mr. Moore seconded <br />the motion. Mr. Moore asked Mr. Boeker about permitting the users. <br />Mr. Boeker stated each user will register and pay a registration fee <br />and will provide a manifest for each load brought in. If the user <br />is not registered when a load is brought in, the registration fee <br />will be charged, and then the load will be charged at a rate of 5 <br />cents per gallon, which has been determined to be the actual cost of <br />treatment per gallon. The loads will be sampled randomly. Mr. <br />Boeker provided the Council with comments received from five users <br />regarding the proposed Ordinance. The Council voted unanimously for <br />approval of the Ordinance on first reading. <br />Mayor Morris introduced for consideration a public hearing and <br />approval of an Ordinance on first reading, the caption which was <br />read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ESTABLISHING INDUSTRIAL USER PERMIT FEES, SURCHARGE <br />FEES, AND COMMERCIAL WASTE HAULER REGISTRATION AND WASTE <br />RECEIVING FEES PURSUANT TO THE INDUSTRIAL WASTE DISCHAGE <br />REGULATIONS ARTICLE OF CHAPTER 30, WATER AND SEWERS AND SEWAGE <br />DISPOSAL, OF THE SAN MARCOS CODE OF ORDINANCESi PROVIDING FOR <br />SEVERABILITYi REPEALING ALL CONFLICTING ORDINANCESi PROVIDING <br />FOR A PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN <br />EFFECTIVE DATE. <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Morris closed the public hearing. Mr. <br />Moore moved for approval of the Ordinance on first reading and Ms. <br />Kissler seconded the motion. The Council asked Mr. Boeker about the <br />charge for the full load vs. partial load. Mr. Boeker stated if <br />there is a sight glass, the City could charge for the actual amount, <br />and without a sight glass, the City would have to charge for a full <br />load. The Council requested amended language for the Ordinance at <br />second reading regarding the cost per load. The Council voted <br />unanimously for approval of the Ordinance on first reading. <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 42.47 <br />ACRES OF LAND, MORE OR LESS, LOCATED SOUTH AND ADJACENT TO THE <br />AIRCRAFT APRON OF THE SAN MARCOS MUNICIPAL AIRPORT, CALDWELL <br />COUNTY, TEXAS, THIS LAND BEING LOCATED WITHIN THE <br />EXTRATERRITORIAL JURISDICTION OF THE CITY AND LYING ADJACENT TO <br />PRESENT CITY BOUNDARIESi APPROVING A SERVICE PLAN FOR THIS <br />
