<br />24 <br /> <br /> <br /> <br />Regular Meeting August 26, 1991 Page 4 <br /> <br /> <br />Ms. Kissler moved for approval of the Ordinance on first reading and <br />Mr. Moore seconded the motion. The Council requested the definition <br />of trailers be provided at the next reading. The Council voted <br />unanimously for approval of the Ordinance on first reading. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 12-8 OF THE SAN MARCOS CODE OF <br />ORDINANCES TO DECREASE THE RESIDENTIAL SOLID WASTE COLLECTION <br />RATE BASED ON RECALCULATION OF THE CONTRACT COLLECTION RATE FOR <br />BROWNING-FERRIS INDUSTRIES, INC.; PROVIDING FOR SEVERABILITY; <br />REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR A PENALTY; <br />PROVIDING FOR PUBLICATION; AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for approval of the Ordinance on first reading and <br />Ms. Kissler seconded the motion. On roll call the following vote <br />was recorded: <br /> <br />AYE: Moore, Hart, Morris, Guerra, Kissler, Plummer. <br /> <br />NAY: Hernandez. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Morris introduced for consideration reconsideration of a <br />Zoning Ordinance. The Council did not wish to reconsider the <br />Ordinance. The caption reads as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING <br />LOT 3, BLOCK 4, OF THE D. S. COMBS ADDITION TO THE CITY OF SAN <br />MARCOS AS RECORDED IN VOLUME 42, PAGE 332 OF THE HAYS COUNTY <br />DEED RECORDS, LOCATED AT 611 MARTIN LUTHER KING DRIVE, FROM "M" <br />(SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT) TO <br />uP" (PUBLIC AND INSTITUTIONAL DISTRICT) AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ESTABLISHING INDUSTRIAL USER PERMIT FEES, SURCHARGE <br />FEES, AND COMMERCIAL WASTE HAULER REGISTRATION AND WASTE <br />RECEIVING FEES PURSUANT TO THE INDUSTRIAL WASTE DISCHARGE <br />REGULATIONS ARTICLE OF CHAPTER 30, WATER AND SEWERS AND SEWAGE <br />DISPOSAL, OF THE SAN MARCOS CODE OF ORDINANCES; PROVIDING FOR <br />SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING <br />FOR A PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for approval of the Ordinance on second reading <br />and Mr. Guerra seconded the motion. Mayor Morris moved to amend the <br />Ordinance on Page 2, Section 3(b) to add: ". . . based upon the <br />actual amount of waste delivered, if this can be readily verified <br />from the outside of the vehicle, or upon 100 percent of the liquid <br />capacity of the vehicle haul tank, . . . ," and Ms. Kissler seconded <br />the motion, which passed unanimously. Bill McDonald requested the <br />Council consider changing the rate per gallon from 5 cents to 3 <br />cents and also suggested only businesses in the City be permitted to <br />do business here, because the Ordinance would now allow for someone <br />to pump in Seguin and dump in San Marcos. Mr. Boeker advised the <br />Council it would be possible to operate the wastewater treatment for <br />3 cents per gallon with some adjustments. Mr. Hart moved to amend <br />the Ordinance on Page 2 in Section 3(b) to change five cents to <br />three cents and Mr. Moore seconded the motion. On roll call the <br />following vote was recorded: <br /> <br />AYE: Moore, Hernandez, Hart, Morris, Kissler, Plummer. <br />NAY: Guerra. <br />ABSTAIN: None. <br />
