<br />29 <br /> <br /> <br /> <br />Regular Meeting August 26, 1991 Page 9 <br /> <br /> <br />Mayor Morris introduced a discussion regarding current legislation <br />affecting the Edwards Aquifer and direction to staff. It was <br />consensus of Council no Resolutions needed to be forwarded <br />supporting legislation, but for Mayor Morris to send thank you <br />letters on behalf of the Council to the legislators who helped San <br />Marcos. <br /> <br />Mayor Morris introduced a discussion regarding the City's support <br />for the purchase of land by the Hays County Appraisal District to <br />relocate their offices and direction to staff. Mr. Moore abstained <br />from the discussion, because he serves on the Hays County Appraisal <br />District Board of Directors. It was consensus of Council to forward <br />a letter to the Hays County Appraisal District advising them why the <br />City is not supportive of their relocation. <br /> <br />Mayor Morris introduced the City Manager's Report. (1) Mr. Gilley <br />recognized Alfonso Carmona who received his Class A certification <br />from the Texas Department of Health. (2) Mayor Morris requested <br />Mr. Gilley provide the Council with information regarding fees and <br />fines of the animal shelter in our city and a comparison with other <br />cities for the budget process. <br /> <br />Mayor Morris introduced the City Attorney's Report. Mr. Bailey, <br />Assistant City Attorney, had no report. <br /> <br />Mayor Morris introduced the City Council's Report. (1) Ms. Kissler <br />reminded the Council the TML Region VII Meeting will be held <br />September 21. (2) Ms. Kissler stated the City needed to forward to <br />Frank Sturzl of TML any nominations for the NLC Board by October 9. <br /> <br />Mayor Morris introduced an Executive Session pursuant to Article <br />6252-17, Section 2(e), V.A.C.S., to discuss pending litigation (In <br />the Matter of City of San Marcos Proceedings Under Section <br />309(a) (3), Clean Water Act, [33 U.S.C. Sec. 1319(a) (3)], In Re: <br />NPDES Permit No. TXO047945, Docket No. VI-91-958, U.S. E.P.A., <br />Region 6), and matters where the duty of the City Attorney to the <br />City pursuant to the Code of Professional Responsibility of the <br />State Bar of Texas clearly conflicts with Article 6252-17. Mr. <br />Moore moved to adjourn into Executive Session at 10:13 p.m. and Mr. <br />Hernandez seconded the motion, which passed unanimously. <br /> <br />Mr. Hernandez moved to reconvene at 12:26 a.m. and Mr. Moore <br />seconded the motion, which passed unanimously (Mr. Guerra left at <br />11:30 p.m.). <br /> <br />The meeting adjourned at 12:27 a.m. on motion made by Mr. Hernandez <br />and sec~ed ~~.
