that a prohibited or excessive fee or charge was made for a non-consent tow, <br /> show up fee, or drop fee. <br /> (c) For a rotation wrecker service or a participating storage facility, a failure to <br /> refund excess charges within 15 days of the pollee el-fliep <br /> . s City Marshal's <br /> decision will result in automatic suspension from the rotation system or <br /> from the list of participating storage facilities until the refund is made. <br /> See. 90.294. Duly to report. <br /> A vehicle storage facility accepting a vehicle that is towed under this <br /> chapter shall,within two hours after receiving the vehicle,report to the San Marcos <br /> Police Department: <br /> LI) A general description of the vehicle; <br /> The state and number of the vehicle's license plate, if any-, <br /> The vehicle identification number of the vehicle, if it can be <br /> ascertained; <br /> �4) The location from which the vehicle was towed; <br /> The name and location of the vehicle storage facility where the <br /> vehicle is being stored. <br /> The report required by this section must be made by telephone or <br /> electronically or delivered personally or by facsimile. <br /> (7) This section does not apply to a vehicle received as a result of a <br /> police-authorized tow. <br /> Sec. 90.295. Penalty Matrix. <br /> Level I Violations 3 or more in a 12-month <br /> period will result in a <br /> mandatory 15-day <br /> SUSPEnsion <br /> (a) Failure to report 2-day suspension <br /> Private Property <br /> Tow within 2-hour <br /> time frame <br /> (b) Failure to respond to 3-day suspension <br /> complaint within 10 <br /> (c) Failure to correct 4-day suspension <br /> inspection failures <br /> within required time <br /> (d) Failure to ensure 4-day suspension <br /> wrecker is properly <br /> equipped <br /> (e) Failure to remove 2-dgy suspension <br /> and properly dispose <br /> of debris <br />
