Subrecipient: Southside Community Center <br /> Organization Type: Non-Profit <br /> Mailinp,Address: 518 S. Guadalupe St, San Marcos,TX 78666 <br /> Award Type & Amount Grant <br /> (Grant or Loan): $800,000 <br /> Final Funding Spend Down December 31',2026 <br /> Date: <br /> 1. Time of Performance <br /> The Subrecipient shall commence performance of its obligations under this Contract Agreement on August 21, <br /> 2024 and complete the Program no later than December 3 I't, 2026, (hereinafter referred to as the"Program <br /> Expiration Date"). <br /> 2. Method of Payment <br /> Payments made by the City of San Marcos to the Subrecipient will be made in the form of both: (1)an advance <br /> payment of up to 15% of the total grant contracted amount; and(2)reimbursement for monies already spent on <br /> eligible Program costs, as discussed in further detail in Section 7 of this Contract Agreement. Within 30 0 days of <br /> receipt of the SLFRF Requisition Form (Exhibit 7),the City of San Marcos will pay out a total of up to 15% of the <br /> total grant contracted amount to the Subrecipient. The City of San Marcos shall make reimbursement payments <br /> only after the Subrecipient has submitted to the satisfaction of the City of San Marcos adequate documentation <br /> confirming the Subrecipient has spent down the advance payment or has verified plans for the immediate use of the <br /> funds. All payments are contingent upon Subrecipient's continued compliance with the provisions set forth in this <br /> Contract Agreement and any/all SLFRF Rules and Regulations 31 CFR Part 35, OMB Uniform Guidance 2 CFR <br /> Part 200,USDT Requirements,the City of San Marcos SLFRF Policies and Procedures, any applicable local, state, <br /> and federal laws, and any applicable USDT and/or City of San Marcos policy memo, regulation, communication or <br /> guideline, as the same may be amended from time to time. <br /> 3. Funding <br /> It is expressly understood that in no event will the total funding exceed $800,000 unless otherwise mutually agreed <br /> upon in writing by amendment to this Contract Agreement. It is expressly understood that funding is contingent <br /> upon the City of San Marcos's receipt of full USDT federal funding and authorization from USDT to use funds in <br /> support of the Program. Any reduction in federal funding may result in reduction or elimination Of funding for this <br /> Contract Agreement. <br /> 4. SLFR Regulations <br /> The Subrecipient shall conduct all work funded under this Contract Agreement in compliance with the following: <br /> • SLFRF's Rules and Regulations 31 CFR Part 35, as amended from time to time,and all other federal <br /> regulations cited herein; <br /> • OMB Uniform Guidance 2 CFR Part 200 -Uniform Administrative Requirements, Cost Principles, and <br /> Audit Requirements for Federal Awards; <br /> • All applicable local, state, and federal laws; and <br /> • Any applicable USDT and/or City of San Marcos Policy Memos, Regulations, Communications, and <br /> guidance. <br /> 5. Program Description,Program Schedule,and Scope of Work <br /> The Subrecipient is responsible for completing the Program in accordance with the approved Program Name, <br /> Program Schedule and Scope of Work as outlined in Exhibit I attached hereto and made a part hereof. In any <br /> instance where the Program Description,Program Schedule and/or Scope of Work may be in conflict with other <br /> terms of this Contract Agreement,the Contract Agreement will prevail. <br /> Page 2 of 14 Initials: <br />
