ORDINANCE 1993- <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 901.5 OF THE <br />STANDARD BUILDING CODE ADOPTED IN SECTION 5-1 OF <br />THE SAN MARCOS CODE OF ORDINANCES REGARDING THE <br />TYPES OF CONSTRUCTION IN WHICH AUTOMATIC SPRINKLER <br />EQUIPMENT MUST BE INSTALLED; PROVIDING FOR <br />SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; <br />PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND <br />PROVIDING AN EFFECTIVE DATE. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. That Section 5-3 of the San Marcos Code of <br />Ordinances is hereby amended by inserting the following revision to <br />the building code adopted in Section 5-1 of the Code of Ordinances: <br />901.5 is amended to read as follows: <br />901.5 General <br />Approved automatic sprinkler equipment meeting the <br />requirements of 901 shall be installed in buildings as <br />follows: <br />1. Residential occupancies with a gross total enclosed <br />floor area of greater than 15,000 sq ft. <br />2. All buildings, except those classified as <br />residential occupancies, with a gross total enclosed <br />floor area of greater than 20,000 sq. ft. <br />3. All buildings four (4) stories or more or having a <br />height of 40 ft or higher. <br />4. Basements having floor areas exceeding 2500 sq ft <br />(232 M2) when used as workshops or for manufacture, <br />repair, sale or storage of combustible materials or <br />when used as lounges or nightclubs regardless of the <br />size. See 402.4.1, Exception 2. <br />5. In buildings which do not have suitable access, as <br />set forth in 703.2, to each story above grade on at <br />least one accessible side of the building. openings <br />which are glazed with security designed to withstand <br />breakage shall not be considered access openings. <br />6. See Chapter 36, Standard Fire Prevention Code. <br />7. See 408.2.2, 412.2.6 and 412.2.2.7. <br />8. Spray finishing booth, area or room shall comply <br />with Chapter 10 of the Standard Fire Prevention <br />Code. <br />SECTION 2. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br />SECTION 2. That all ordinances and resolutions or parts of <br />ordinances or resolutions in conflict herewith are hereby repealed. <br />SECTION 3. That any person violating any provision of this <br />ordinance shall be deemed guilty of a misdemeanor and upon <br />conviction shall be subject to the penalty provided in Section 1-5 <br />of the San Marcos Code of ordinances. <br />�6 <br />
