1.02 Proposed Schedule of Development and Phasing <br /> A. Phasing is anticipated as depicted in Exhibit "C" Conceptual Phasing Plan. <br /> 1.03 Base Zoning District(s) <br /> A. The Project will be developed using Heavy Industrial or Heavy Commercial <br /> as the base zoning district(s). <br /> 1.04 Development Standards: <br /> A. All City of San Marcos codes and ordinances in effect on the Effective Date <br /> of this Agreement shall govern throughout the term of this Project, except <br /> as noted within this Agreement. In the event of a conflict between this <br /> Agreement and the SMDC or the City's Codes and Ordinances, this <br /> Agreement shall control. <br /> B. Pursuant to the City's authority under section 2.4.5.1 of the City's <br /> Development Code and under Section 212.172 of the Texas Local <br /> Government Code, the City hereby agrees to the following waivers and <br /> modifications to the following requirements of such Development Code with <br /> respect to the Property or any portion of the Property, as applicable: <br /> 1, Section 3.6.2.1, Table 3.1 which requires a maximum 5,00 <br /> 0 ft block <br /> perimeter and maximum 400 ft dead end street length in EC, HC, HI <br /> and I-I zoning districts is modified to allow 10,000 ft. maximum block <br /> perimeters which shall include Thoroughfare Plan Roads as <br /> illustrated in Exhibit "E". <br /> 2. Section 4.3.5.3, which limits the blank wail area of a building based <br /> on the associated zoning district, shall be modified as follows: <br /> i. Horizontal Articulation. Blank walls visible from and within 300 <br /> feet of a public right-of-way or a residentially zoned property <br /> shall not extend for a distance greater than four (4) times the <br /> wall's height without having an off-set of ten percent (10%) of <br /> the wall's height (maximum of five (5) feet); the new plane <br /> shall extend for a distance equal to a minimum of twenty <br /> percent (20%) of the maximum length of the first plane. Walls <br /> not visible from or within 300 feet of a public right-of-way or a <br /> residentially zoned property and loading dock doors are <br /> exempt from the horizontal articulation requirement. <br /> ii. Vertical Articulation. Walls visible from and within 300 feet of <br /> a public right-of-way or a residentially zoned property shall not <br /> extend for a distance greater than four (4) times the height of <br /> the wall without changing height by a minimum of ten percent <br /> (10%) of the wall's height (maximum of five (5) feet).
