By and through the Subrecipient's execution of this Agreement,the Subrecipient warrants and <br /> represents that the Subrecipient will not obligate or expend funds awarded under this Agreement for"covered <br /> telecommunications equipment or services"(as this term is defined and this restriction is imposed under 2 CFR <br /> 200.216). <br /> 2.13.Domestic Preference for Procurements. <br /> a)Under this Agreement and in accordance with 2 C.F.R. §200.322,the Subrecipient shall to the greatest <br /> extent practicable,provide a preference for the purchase, acquisition, or use of goods,products or <br /> materials produced in the United States(including but not limited to iron,aluminum, steel, cement,and <br /> other manufactured products). <br /> b) For purposes of this agreement,the following definitions apply: <br /> i. "Produced in the United States"means,for iron and steel products,that all manufacturing <br /> processes, from the initial melting stage through the application of coatings,occurred in the United <br /> States; and <br /> ii. "Manufactured products"means items and construction materials composed in whole or in part <br /> of non-ferrous metals such as aluminum;plastics and polymer based products such as polyvinyl <br /> chloride pipe; aggregates such as concrete;glass,including optical fiber; and lumber. <br /> 3. REPRESENTATIONS,CERTIFICATIONS,AND OTHER STATEMENTS RELATING TO <br /> FEDERAL FUNDS—FUNDING SOURCE SPECIFIC <br /> Subrecipient acknowledges that when all or part of this Agreement is funded by a federal award that certain <br /> representations, certifications, and other statements relating to the use of such funds or performance of the Project <br /> may be necessary. These representations,certifications and other statements are set forth below. Unless otherwise <br /> stated in this Agreement,the execution and submission of this Agreement serves as affirmative acknowledgment <br /> of and agreement with the below representations, certifications,and other statements. Further, should <br /> circumstances of the Subrecipient change during the performance of this Agreement that would render one of <br /> these representations, certifications and/or other statements inaccurate,invalid or incorrect,the Subrecipient shall <br /> promptly notify SFI of such change in circumstance.Finally, SFI reserves the right to update and require <br /> subsequent acknowledgement of and agreement with new or revised representations, certifications,and other <br /> statements at no additional cost under this Agreement. <br /> 3.1. Department of Agriculture. <br /> 3.1.1. National Enviromnental Policy Act;the Endangered Species Act;and the National Historic <br /> Preservation Act. <br /> As a condition of this award,the Subrecipient is approved to begin planning and design aspects related to this <br /> award.All project activities must be reviewed and comply with National Enviromnental Policy Act(NEPA), <br /> Endangered Species Act(ESA), and Section 106 of the National Historic Preservation Act(NHPA). Once the final <br /> project plans are available and draft compliance documents completed,the Subrecipient must submit them to the <br /> U.S.Fish and Wildlife Service(Service),directly or through SFI.No on the ground work or activities that have <br /> the potential to affect resources protected by these Acts will begin until the Service has reviewed,finalized the <br /> compliance documents, and notified the Subrecipient in writing that such work can begin. In the event any <br /> archaeological or historic materials are encountered during project activity,work in the immediate area must stop <br /> and the following actions taken: <br /> 29 <br />
